Es REGULAR MEETING SEPTEMBER 10, 1984 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, September 10, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Crone, Paszak, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your sub - committee on the inspection and supervision of the minutes would res- pectfully report that it has inspected the minutes of the August 27, meeting of the Council and found them correct. The sub - committee, therefore, recommends that the same be approved. /s/ Beverlie J. Beck /s/ Ann B. Puzzello /s/ Thomas Zakrzewski Council Member Serge made a motion that the minutes of the August 27, meeting of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. REPORTS Council Member Voorde indicated that the Zoning and Vacation Committee had met on Bill Nos. 71 and 98 -84, and recommended them favorable. Council Member Braboy indicated that the Human Resources Committee had met on Resolution 9D and recommended it favorable. Council Member Puzzello made a motion to resolve into the Committee of the Whole, seconded by- Council Member Taylor. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on August 27, at 7:05 p.m., with nine members present. Chairman Serge presiding. BILL NO. 71 -84 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE) (PROGRESS AND KNOBLOCK ST.) This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Larry Magliozzi, of Area Plan, gave the Commission report, which was favorable, subject to the release of all utility easements within the vacated portion of Maplewood Avenue and a final site plan. Kenneth Fedder, attorney for the petitioner, made the presentation for the bill. He indicated this rezoning was being requested to allow for the expansion of the Stanz Cheese Company warehouse. Council Member Voorde made a motion to amend the bill in Section 1, after the word Area, to read "Subject to the release of all utility easements within the vacated portion of Maplewood Street and a final site plan. ", seconded by Council Member Beck. The motion carried. Council Member Voorde made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Crone. The motion carried. BILL NO. 98 -84 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST 14' EAST WEST ALLEY NORTH OF LINCOLN WAY WEST RUNNING EAST FROM SANCOME AVENUE EAST TO THE INTERSECTING NORTH -SOUTH ALLEY ABUTTING LOTS 39 AND 40 FOR A DISTANCE OF 134 FEET, ALL BEING IN A. H. CUSHING'S ADDITION TO THE CITY OF SOUTH BEND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Oxian, 1533 Lincoln Way West, made the presentation for the bill. He indicated he owned the property at 742 Sancome. He indicated this alley is now being used as a dump. He indicated he planned to close the alley and build at garage across it. Council Member Voorde made a motion to recommend this bill to the Council favorable, seconded by Council 1Member Zakrzewski. The motion carried. BILL NO. 83 -84 A BILL AMENDING CERTAIN SECTIONS OF CHAPTER 21, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND REGULATING CONTROLLED USES.
