RESOLUTION NO. 13-2026 <br /> <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH <br />BEND, INDIANA AUTHORIZING STAFF TO EXECUTE AND RECORD REQUIRED <br />LIEN RELEASED RELATED TO AND FOR THE PERFORMANCE OF LEAD <br />HAZARD CONTROL SERVICES <br /> <br />WHEREAS, the City of South Bend, Indiana’s (“City”) Board of Public Works (the <br />"Board") exists pursuant to Indiana Code Section 36-4-9-5 and is the appropriate body to hold <br />real estate interests of the City pursuant to Indiana Code Section 36-9-6-3; and <br />WHEREAS, the City, accepted grants for lead hazard reduction (the "Program") from the <br />Indiana Housing and Community Development Authority and the United States Department of <br />Housing and Urban Development ("HUD"); and <br />WHEREAS, the City executed certain grant documents and the Program is administered <br />by the City's Department of Community Investment ("DCI"); and <br />WHEREAS, the Board adopted Resolution 12-2022 on March 12, 2022 which the Board <br />authorize any staff member of the City's DCI to accept and present certain documents related to <br />the execution of the Program for recordation and execute on the Board's behalf any document or <br />take on the Board's behalf any action that may be required to complete the recordation of <br />documents related to the Program and carry out the purposes of this Resolution; <br />WHEREAS, the Board desires to grant further authorization to DCI, and its designees, to <br />execute and record any and all lien release documentation necessary for the successful <br />administration of the Program. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND AS FOLLOWS: <br /> <br />1. The Board reaffirms its approval of the grant documents in furtherance of the <br />Program. <br /> <br />2. The Board further reaffirms Resolution 12-2022. <br /> <br />3. The Board further authorizes the City's Department of Community Investment or <br />its designees, to execute and record any and all lien release documentation related to the <br />successful administration of the Program. <br /> <br />4. This Resolution will be in full force and effect upon its adoption. <br />
