South Bend, IN <br /> South Bend, Indiana 46601 <br /> RE: Ordinance to Establish Certain Boundaries for South Bend Utility Service <br /> Dear President Lee, <br /> Please find attached for your consideration an Ordinance of the Common Council of the South Bend, <br /> Indiana,establishing the defined boundaries within which the City of South Bend,Indiana("City") <br /> municipal utilities may furnish water and sewage services to the public. <br /> This proposed ordinance formally recognizes a utility service territory that includes the City's corporate <br /> limits and extends up to four(4)miles beyond those limits,as authorized under Indiana Code 36-9-2-14, <br /> 36-9-2-16,and 36-9-2-18.The designated territory expressly excludes areas within the corporate <br /> boundaries of the Mishawaka and any properties lawfully served by another existing utility as of the date <br /> of adoption. <br /> Importantly,the establishment of this territory does not impose an obligation on the City to extend or <br /> provide water or sewer service to all properties within the mapped area.Rather, it affirms the City's <br /> exclusive statutory right to furnish such services within the territory should the City elect to do so, <br /> consistent with municipal policy,capacity,and long-term planning considerations. <br /> This ordinance further supersedes and replaces Ordinance No. 10294-14 in its entirety,providing an <br /> updated and comprehensive framework consistent with current statutory authority and municipal policy. <br /> The City intends to submit this Ordinance and the proposed Utility Boundary Map to the Indiana Utility <br /> Regulatory Commission upon Council's passage. <br /> Thank you for your time and thoughtful consideration. <br /> Rep tful�lyy submi ed, <br /> Eric C) Swat <br /> Executive Director, Public Works <br /> ENGINEERING I SOLID WASTE I STREETS, SEWERS AND TRAFFIC & LIGHTING WASTEWATER I WATER <br /> 215 S.
