BILL NO. 114 -79 ORDINANCE NO. _�aKa qt _ ?C AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 8, COMMONLY KNOWN AS TRUCK ROUTES BY AMENDING SECTION 20 -109 TO INCLUDE DELIVERY AND UNLOADING EXCEPTIONS, PARKING PROHIBITIONS, AND PENALTIES STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes the contri- butions being made to our community by intercity trucks transporting goods to and from our City. However, the Council also recognizes that travel and parking of intercity trucks through and in the residential areas of the City causes noise problems and contributes to the deterioration and damage_to_ the. City streets. Therefore, the Council believes that reasonable regulations are needed by specifically defining loading or delivery exceptions, parking prohibitions and penalties which pertain to intercity trucks. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I: Chapter 20, Article 8, Commonly known as Truck Routes of the Municipal Code of the City of South Bend, Indiana, is hereby amended by the addition of subsections 20 -109 (d), (e), and (f) which shall read as follows: SEC. 20 -109 Use of City Streets by intercity trucks as defined in section 20 -106 (3) (d) All intercity trucks as defined in this Article shall proceed by the shortest combination of State and Federal highways, City truck routes and access routes shown upon "schedule A -1", and shall be prohibited from riving upon any of er city streets unless said vehicle is in the process of delivering or picking up goods. A written bill of lading or similar document must be produced by the driver if stopped while driving on a city street which is not designated as a City truck route, access route as shown in "Schedule A -1 11,or detour route to verify such pick -up or el.ivery. (e) All intercity trucks as defined in this Article shall be prohi- bited from parking on city streets unless designated otherwise by a Era tic sign. This prohibition shall not apply to intercity trucks parked and in the process of loading or unloading goods. (f) Anyone who violates the provisions of this Article may be fined up to a maximum of three hundred dollars ($300.00), and said Article shall be enforced by the Police Department pursuant to the procedures set forth in Section 20 -17.
