RESOLUTION NO. 27-2025 <br />A RESOLUTION OF THE CITY OF SOUTH BEND, ACTING THROUGH ITS BOARD <br />OF PUBLIC WORKS APPROVING THE TRANSFER OF REAL PROPERTY TO THE <br />SOUTH BEND REDEVELOPMENT COMMISSION <br />WHEREAS, the City of South Bend, acting through its Board of Public Works (the <br />“City”), is the owner of certain property identified herein; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City may transfer or exchange property with <br />another governmental entity upon terms and conditions agreed upon by the two (2) entities as <br />evidenced by the adoption of substantially identical resolutions of each entity; and <br />WHEREAS, the South Bend Redevelopment Commission (the “Commission”), the <br />governing body of the South Bend, Indiana, Department of Redevelopment (the “Department”), <br />exists and operates under the provisions of I.C. 36-7-14, as amended from time to time (the “Act”), <br />and is a body corporate and politic; and <br />WHEREAS, the City desires to the transfer to the Commission certain real property <br />commonly known as 105 S. Olive St., and more particularly set forth in Exhibit “A” attached (the <br />“Property”); and <br />WHEREAS, the Commission desires to accept the transfer of the Property from the City <br />for purposes of redevelopment and will execute a mirroring resolution documenting such desire; <br />and <br />WHEREAS, the Commission is expected to adopt a corresponding resolution consistent <br />with I.C. 36-1-11-8. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF <br />WORKS AS FOLLOWS: <br />1.The transfer of the following described real property situated in St. Joseph County, <br />Indiana: <br />See Exhibit “A” <br />by the City to the Commission, without consideration, shall be, and hereby is, approved and <br />authorized. <br />2.The Property Development Manager of Growth & Opportunity for the City of <br />South Bend shall cause the recording of a quit claim deed conveying all the right, title and interest <br />of the South Bend Redevelopment Commission in and to the Property, for the use and benefit of <br />its Department of Redevelopment. <br />3.This Resolution shall be in full force and effect upon its adoption.
