ZONING & ANNEXATION <br />3:30 P.M. <br />May 13, 2013 <br />Committee Members Present: Dr. Fred Ferlic, Oliver Davis, Henry Davis, Gavin Ferlic <br />Citizen Members: Kyle Chamberlin <br />Other Council Present: Tim Scott, Valerie Schey, Karen White, Derek Dieter <br />Others Present: Carol Davis, Christa Nayder, Scott Ford, Kimberly Clendenin, Mark Neal, Eric Hansen, <br />Glenda Rae Hernandez, Mike Divita <br />Dr. Fred Ferlic Chairperson of the Zoning & Annexation Committee, called the meeting to order for the <br />purpose of considering Bill No. 11 -13. <br />This bill petitions the Council to rezone and grant a special exemption for the expansion of a used car <br />sales and storage lot at 3901 Western Avenue. <br />Christa Nayder reported that the Area Plan Commission had ruled favorably on the petition with certain <br />provisos mostly requiring screening. <br />Kimberly Clendenin made the presentation for the petition citing the screening agreements and <br />emphasizing the fact that this was a long -term successful business that was only asking to increase the <br />size of the lot. <br />Valerie Schey opened the Council discussion asking for definition of the zoning categories at issue, they <br />being mixed use and commercial business. Oliver Davis, the Council representative to the APC, <br />recounted issues raised and accommodations agreed to at the APC hearing Karen White voiced <br />concerns about more used car lots on Western Avenue, a long standing Council concern. Henry Davis <br />said this type of request for this type of business raises foundational issues, specifically the need for a <br />long -term economic development plan for the corridors. Valerie Schey asked if failure to pass would put <br />the owner out of business. The answer was no. Kyle Chamberlin said one of the most important things <br />business investors seek is predictability in government. The petitioner was granted approval to operate is <br />2005. Why not now? <br />Mike Divita from the City's Community Investment Department said the City does not support expanded <br />automotive on Western. <br />Kimberly Clendenin wondered why the City would thwart a successful long -term business. <br />Finally, Gavin Ferlic motioned to continue the bill until 6 -10.
