Criteria for Decision Making
Special Exception - if applicable
A Special Exception may only be granted upon making a written determination, based upon the
evidence presented at a public hearing. Please address how the project meets the following criteria.
(1) The proposed use will not be injurious to the public health, safety, comfort,
community moral standards, convenience or general welfare, because:
The approval of the Special Exception should not be injurious to the general
welfare of the community. The request to allow a Day Care Center is in line
with the vision of the Downtown South Bend Master Plan as well as
community feedback.
(2) The proposed use will not injure or adversely affect the use of the adjacent area
or property values therein, because:
A Day Care Center would be a positive amenity for families within the
development and in the surrounding neighborhoods. This should not
detrimentally affect surrounding properties.
(3) The proposed use will be consistent with the character of the district in which it is
located and the land uses authorized therein, because:
The development area is adjacent to a variety of building uses, and a Day
Care Center is appropriate for a mixed-use neighborhood near downtown.
(4) The proposed use is compatible with the recommendations of the Comprehensive
Plan, because:
Community engagement through plan studies and charrettes have identified
a Day Care Center as a desire of neighbors in the plan area.
