Medical Review Officer means a person who is a licensed physician and who is responsible for receiving and <br />(MRO) reviewing laboratory results generated by an employer's drug testing program and <br />evaluating medical explanations for certain drug test results. <br />Negative result The result reported by an HHS-certified laboratory to an MRO when a specimen <br />contains no drug or the concentration of the drug is less than the cutoff concentration <br />for the drug or drug class and the specimen is a valid specimen. <br />NHTSA National Highway Traffic Safety Administration <br />Non -negative specimen A urine specimen that is reported as adulterated, substituted, positive (for drug(s) or <br />drug metabolite(s)), and/or invalid. <br />ODAPC The office in the Office of the Secretary, DOT, that is responsible for coordinating drug <br />Office of Drug and and alcohol testing program matters within the Department and providing information <br />Alcohol Policy and concerning the implementation of 49 CFR Part 40. ODAPC website at: www.dot.gov/ost/dapddocuments,html?documents <br />Oxidizing adulterant A substance that acts alone or in combination with other substances to oxidize drugs <br />or drug metabolites to prevent the detection of the drug or drug metabolites, or affects <br />the reagents in either the initial or confirmatory drug test. <br />Positive result <br />(alcohol) Refusal to submit a specimen OR an alcohol concentration of 0.02 or greater on a <br />test performed by a Breath Alcohol Technician on Evidential Breath Testing equipment <br />or by other means (if required by circumstances and not prohibited by a Federal reg). <br />(drugs) The result reported by an HHS-certified laboratory when a specimen contains a drug or <br />drug metabolite equal to or greater than the cutoff concentration. <br />Primary specimen In drug testing, the urine specimen bottle that is opened and tested by a first laboratory <br />to determine whether the employee has a drug or drug metabolite in his or her system; <br />and for the purpose of validity testing. The primary specimen is distinguished from the <br />split specimen, defined in this section. <br />Prohibited drug With regard to an employer having "actual knowledge" of an employee's misuse <br />of drugs or alcohol, "prohibited drug" means any controlled substance where the <br />controlled substance has been dispensed or used or is in the individual's possession <br />in a manner not approved by the FDA, including a controlled substance prescribed for <br />another person. <br />Qualification Training The training required in order for a collector, BAT, MRO, SAP, or STT to be qualified to <br />perform their functions in the DOT drug and alcohol testing program. Qualification <br />training may be provided by any appropriate means (e.g., classroom instruction, <br />internet application, CD-ROM, video). <br />Reconfirmed The result reported for a split specimen when the second laboratory is able to <br />corroborate the original result reported for the primary specimen. <br />Redact To put into suitable literary form; revise; edit (See 40.329(c)). <br />Refresher Training The training required periodically for qualified collectors, SATs, and STTs to review <br />basic requirements and provide instruction concerning changes in technology (e.g.. <br />new testing methods that may be authorized) and amendments, interpretations, <br />guidance, and issues concerning this part and DOT agency drug and alcohol testing <br />regulations. Refresher training can be provided by any appropriate means (e.g., <br />classroom instruction, internet application, CD-ROM, video). <br />Refusal to test or to <br />Means any circumstance outlined in 49 CFR 40.191 and 40.261. <br />submit a specimen <br />See 49 CFR 40.355 (i) and 6) regarding limitations on Service Agents with regard <br />to making a determination that an employee has "refused a drug or alcohol test". <br />This determination is almost exclusively a "non -delegable" responsibility of the DER. <br />Rejected for testing <br />The result reported by an HHS-certified laboratory when no tests are performed for a <br />specimen because of a fatal flaw or a correctable flaw that is not corrected. <br />Return -to -duty testing <br />Required following a violation of DOT drug and alcohol agency regs, [See 40,281-313] <br />Safety -sensitive <br />Any on -duty functions under 395.2(1)-(7). A driver is "performing" safety - <br />function <br />sensitive functions during any period in which the driver is actually performing, <br />FMCSA: <br />ready to perform, or immediately available to perform such functions. <br />See individual DOT agency regulations for their respective definitions. <br />Screening drug test See Initial drug test definition above. <br />Screening Test means a person who instructs and assists employees in the alcohol testing process <br />technician (STT) and operates an alcohol screening device. <br />Service agent Any person or entity, other than an employee of the employer, who provides services <br />specified under this part to employers and/ or employees in connection with DOT drug <br />and alcohol testing requirements.
