<br />2 <br />1.2 Funding Amount. “Funding Amount” means an <br />amount not to exceed Three Million Three Hundred Thousand <br />Dollars ($3,300,000.00) of tax increment finance revenues provided <br />to the City by the Commission, subject to annual appropriation by <br />the Commission, to simultaneously reimburse the City for its costs <br />incurred, or to be incurred, through the Loan Agreement that will be <br />subsequently executed by the Parties pursuant to the terms of the <br />Loan Agreement, which will be used for paying a portion of the <br />Local Public Improvements. <br />b) A new Section 1.4 shall be inserted in SECTION 1. DEFINITIONS, which <br />states as follows: <br />1.4 Additional Funding Amount. “Additional Funding <br />Amount” means an amount not to exceed Three Hundred Three <br />Thousand Dollars ($303,000.00) of tax increment finance revenues <br />to be used for (i) paying the costs associated with the Local Public <br />Improvements procured by the Board of Works to equip, purchase, <br />and deliver, or cause to be purchased and delivered, exterior siding <br />or other materials supporting architectural and other improvements <br />to the Project and (ii) completing or causing to be completed any <br />other Local Public Improvements. <br />c) A new Section 1.5 shall be inserted in SECTION 1. DEFINITIONS, which <br />states as follows: <br />1.5 Board of Works. “Board of Works” means the Board <br />of Public Works of the City, a public body granted the power to <br />award contracts for public works pursuant to I.C. 36-1-12. <br />d) In the last sentence of Section 3.1, the text “January 31, 2024” shall be <br />deleted and replaced with the following: “January 31, 2026.” <br />e) Section 3.3 shall be deleted in its entirety and replaced with the following <br />text: <br />3.3 Timeframe for Completion. The Developer hereby <br />agrees to complete the Project as set forth in the Project Plan and <br />any other obligations the Developer may have under this Agreement <br />by the completion date established in the Purchase Agreement, or <br />otherwise agreed between the Developer and the Commission, as <br />may be modified due to unforeseen circumstances and delays (the <br />“Mandatory Project Completion Date”).
