DEED OF DEDICATION OF RIGHT OF WAY THIS INDENTURE, made and entered into this 12th day of August, 2025, by and between the City of South Bend, Indiana, acting through its Board of Public Works, a municipal corporation organized under the laws of the State of Indiana ("Grantor"), and the City of South Bend, Indiana, acting through its Board of Public Works ("Grantee") WHEREAS, the City of South Bend is the owner of certain real estate located in St. Joseph County, Indiana, and more particularly described in Exhibit A attached hereto and incorporated herein by reference (the "Property"); and WHEREAS, the Grantor desires to dedicate the Property as public right-of-way. WITNESSETH: for and in consideration of One Dollar ($1.00) and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Grantor hereby GRANTS, CONVEYS, and DEDICATES the Property to the City of South Bend, Indiana, the following described property as public right-of-way: A part of the southeast quarter of Section 7, Township 37 North, Range 3 East, City of South Bend, Portage Township, St. Joseph County, Indiana, as depicted on the attached right-of-way parcel plat of Parcel 1 and being more particularly describes as follows: Commencing at the southwest corner of Lot 222 of Berner Grove Second Addition to River Park (now City of South Bend) as recorded in Plat Book 8, Pages 122 and 123 in the St. Joseph County Recorder's Office, designated as point "300" on said parcel plat; thence North 89' 11'02" West across a platted alley in said addition, 14.00 feet to point "301" as designated on said plat, being a point on the east line of the Grantor's land, also being on the east line of said southeast quarter, also being the point of beginning; thence South 00°06'21" East along the east line of the Grantor's land and the east line of said southeast quarter, 80.01 feet to point "302" as designated on said plat, thence North 89°04'47" West, 1291.55 feet to point "303" as designated on said plat, being a point on the westerly line of the Grantor's land, also being a southern extension of the east right-of-way line of Greenlawn Avenue; thence North 00°10'06" West along the westerly line of the Grantor's land and the east line of Greenlawn Avenue, 80.01 feet to point "304" as designated on said plat; thence South 89°04'47" East, 1291.64 feet to the point of beginning and containing 2.37 acres, more or less. The Grantor further warrants that it is the sole owner of the Property and has the authority to dedicate it for public use as described herein.
