ENGINEERS JOINT CONTRACT <br />DOCUMENTS COMMITTEE <br />AGREEMENT <br />BETWEEN OWNER AND ENGINEER <br />FOR <br />PROFESSIONAL SERVICES <br />THIS IS AN AGREEMENT effective as of July 22 , 2025 ("Effective Date") between <br />Board of Public Works, City of South Bend, Indiana ("Owner") and <br />Black & Veatch Corporation ("Engineer"). <br />Owner's Project, of which Engineer's services under this Agreement are a part, is generally identified as <br />follows: <br />North WTP PFAS Minimization Project ("Project"). <br />Engineer's services under this Agreement are generally identified as follows: <br />The Project includes preliminary design, detailed design, and bid phase engineering services for <br />modifications at the existing North Water Treatment Plant (WTP) to incorporate PFAS treatment <br />process steps. The modifications include constructing an upper level within the High Service Pump <br />Station (HSPS) to house four (4) anion exchange (AIX) vessels, impeller and motor modifications to <br />the four existing high service pumps, installation of variable frequency drives on the four existing high <br />service pumps, relocation of chlorine and fluoride feed points in the HSPS, a new sodium bisulfite <br />chemical feed room and system to be incorporated into the existing building, miscellaneous HVAC <br />and plumbing improvements, and associated process, structural, electrical, and I&C improvements. It <br />is anticipated that construction phase services will be included in a future amendment. <br />Owner and Engineer further agree as follows: <br />ARTICLE 1— SERVICES OF ENGINEER <br />1.01 Scope <br />A.
