ORDINANCE NO. (,07,1g_® <br />AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 1., <br />SECTION 2 -11 OF THE MUNICIPAL CODE OF THE CITY <br />OF SOUTH BEND, INDIANA, COMMONLY REFERRED TO <br />AS COMMITTEE OF THE WHOLE COUNCIL: COMPOSITION, <br />PROCEDURE, POWERS AND DUTIES <br />The Common Council recognizes that public hearings on all <br />proposed ordinances and resolutions play a vital and important role. <br />The Council further recognizes that procedures governing such <br />public hearings should ensure fairness to all parties while maintaining <br />order. <br />Therefore, in the interest of clarifying the procedure used <br />during a public hearing, the following bill is introduced. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council for the <br />City of South Bend, Indiana, as follows: <br />SECTION I. Chapter 2, Article 1, Section 2 -11 of the Municipal <br />Code of the City of South Bend, Indiana, is amended by the addition <br />of a new sub - section (d) which shall read as follows: <br />(d) Public hearings on all bills, proposed resolutions, and <br />petitions shall be conducted as follows: <br />(1) Reading of the title by the City Clerk. <br />(2) Reports from any City Departments, Common Council <br />Committees, or the Area Plan Commission if such item was <br />referred for review and recommendation. <br />(3) Formal presentation in favor, followed by members <br />of the public supporting the item. <br />(4) Formal presentation against the item, followed by <br />members of the public opposing the measure. This portion <br />shall be equal in time to the presentation in favor, or a <br />minimum of fifteen (15) minutes if needed. <br />(5) Five minute rebuttal for the person or persons who <br />gave the formal presentation in favor of the item, after <br />which the public portion of the hearing is closed. <br />(6) Council portion. <br />SECTION II.
