Staff Report— BZA#0356-25 July 1025 <br /> Criteria for Decision Making: Special Exception <br /> A Special Exception may only be granted upon making a written determination, based upon <br /> the evidence presented at a public hearing, that: <br /> (1) The proposed use will not be injurious to the public health, safety, comfort, <br /> community moral standards, convenience or general welfare; <br /> The proposed use should not be injurious to the public health, safety, comfort, community <br /> moral standards, convenience, or general welfare. This is activating a vacant school building <br /> to become a school. <br /> (2) The proposed use will not injure or adversely affect the use of the adjacent area or <br /> property values therein; <br /> The propose use should not injure or adversely affect the use of the adjacent area or <br /> property values therein. This is activating a vacant school building to become a school in a <br /> residential neighborhood. <br /> (3) The proposed use will be consistent with the character of the district in which it is <br /> located and the land uses authorized therein; <br /> The proposed use should be consistent with the character of the district in which it is located <br /> and the land uses authorized therein. This institutional use is activating a vacant school, <br /> which is consistent with the intent of the U1 zoning district. <br /> (4) The proposed use is compatible with the recommendations of the Comprehensive <br /> Plan. <br /> The propose use is compatible with the recommendations of the Near Westside <br /> Neighborhood Plan (2022). The plan indicates an educationaluse occupying this space. <br /> Analysis & Recommendation <br /> Analysis: Originally the parochial school for St. Stephen Catholic Church and later the location <br /> of El Campito, this vacant school building can continue to serve as a place of learning and a <br /> community space, as envisioned by the Near Westside Neighborhood Plan. <br /> Staff Recommendation: Based on the information provided prior to the public hearing, the staff <br /> recommends the Board send the petition to the Common Council with a favorable <br /> recommendation. <br /> SOUTH BEND BOARD OF ZONING APPEALS Page 3 o <br />
