ORDINANCE NO. <br />AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN <br />CHAPTER 2, ARTICLE 1, OF THE MUNICIPAL CODE <br />OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY <br />REFERRED TO AS THE COMMON COUNCIL <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend recognizes that <br />it has the authority to "adopt local laws deemed necessary for the <br />effective operation and conduct of government with respect to <br />municipal and internal affairs." <br />The Council further recognizes that the rules and regulations <br />of the Council were enacted prior to the passage of the 1977 Indiana <br />Open Door Law found at Indiana Code Section 5- 14 -1.5 -1 through <br />5- 14- 1.5 -7. <br />In the interest of clarifying the regulations regarding the <br />reporting of minutes of committee meetings of the Council, and in <br />the interest of being consistent with the state law, the following <br />bill is introduced. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City <br />Of South Bend, Indiana, as follows: <br />SECTION I. Chapter 2, Article 1, Section 2 -7 of the Municipal <br />Code of the City of South Bend, Indiana, commonly known as Duties of <br />City Clerk as Clerk of Council, is hereby amended by the addition <br />of new sub - section (j) which shall read in its entirety as follows: <br />(j) The Cit Clerk's Office shall maintain all minutes 7: 11 of the standing and special committees of the Common Council <br />Which are dul 'filed with said office by the Chairman of the <br />Committee. The minutes shall be maintained with the notices <br />of such meetings in a separate and <br />commi tee, pll folders shall be openrforepublicdinspectionh <br />and available for copying at a reasonable cost to members of <br />h e p ublic. <br />t <br />SECTION II, Chapter 2, Article 1, Section 2 -10 of the Municipal <br />Code of the City of South Bend, Indiana, commonly known as Standing <br />Committees of the Common Council; titles and responsibilities, is her <br />amended by amending sub - section (f) as follows: eby <br />(f) Responsibilities and scope of Council Committees: <br />The general responsibilities of each Council committee shall <br />include the right to review all legislative proposals, reports <br />and other pertinent information under its jurisdiction; and to <br />monitor on a continuing basis the department, bureau and <br />public officials under its jurisdiction. Ech <br />shall report periodically to the Council, with committee <br />dam }��e�- �epe��s -be <br />the minutes o �ee written reports of <br />f each meeting being filed with the City Clerk <br />within two (2) weeks after each meetin <br />include the followin g• Said reports shall <br />g: (i) date, time, and place of the meeting; <br />�-� persons in attendance; iii general substance of all matters <br />proposed, discussed, or decided; and (iv a record of all <br />votes taken, if any.
