Peterson, Assistant City Attorney for the City of South Bend, Indiana, who <br />being duly sworn upon his oath respectfully states as follow: <br />1. My name is Shawn E. Peterson, and I have personal knowledge of, and am competent to <br />testify to, the matters set forth herein. <br />2. The City of South Bend, Indiana (the "City") negotiated a Corporate Quitclaim Deed and <br />a Temporary Easement Agreement with Advance Stores Company, Incorporated, which <br />deed and agreement were duly executed and delivered to the City for recording. <br />3. The Corporate Quitclaim Deed and the Temporary Easement Agreement were recorded <br />in the St. Joseph County Recorder's Office on June 16, 2006 as Instruments No. 0625634 <br />and No. 0625637, respectively. <br />4. In preparation for said recording, the exhibits on the two documents were inadvertently <br />switched. The Corporate Quitclaim Deed and the Temporary Easement Agreement, as <br />re -recorded on June,-122006, as Instruments No. oC, ,(_,K y and No. t1 <br />are correct and supersede the previously recorded documents. <br />Further affiant sayeth not. <br />Dated this day of June, 2006. <br />STATE OF INDIANA <br />ST.
