v. All reasonable steps will betaken to obtain a urine sample for the testing of <br />Controlled Substances from an employee after an accident. <br />1. In case of a conscious but hospitalized employee, the hospital or <br />medical facility will be requested to obtain a sample and, if necessary, <br />reference will be made to the DOT drug testing requirements. <br />2. If an employee who is subject to post -accident testing is conscious, <br />able to urinate normally (in the opinion of a medical professional) and <br />refuses to be tested, that will be considered a test refusal. <br />Reasonable Suspicion Testing <br />a. When there is reasonable suspicion to believe that a Covered Employee is using a <br />Controlled Substance or alcohol in violation of Section 4.05.02 of this Policy, the <br />employee will be required to take a Test for Controlled Substances and/or an Alcohol <br />Test. <br />i. The required observations for Reasonable Suspicion Testing shall be made by a <br />supervisor or PCC representative who is trained by the Employee Assistance <br />Program, or an equivalent program, in drug and/or alcohol use symptoms. <br />ii. The supervisor or PCC representative who requires the test may not administer <br />the test. <br />b. Reasonable Suspicion <br />i. A decision to test must be based on specific contemporaneous, articulable <br />observations concerning the appearance, behavior, speech, or body odors of <br />the employee. The observations may include indications of the chronic and <br />withdrawal effects of Controlled Substances or alcohol. <br />c. Timeframe for Testing Employees <br />If an Alcohol Test is required but is not administered within two (2) hours <br />following the request for the test, PCC shall prepare and maintain on file a <br />record stating the reasons the test was not promptly administered. If a required <br />test is not administered within eight (8) hours following the request, the operator <br />shall cease attempts to administer an Alcohol Test and shall state in the record <br />the reasons for not administering the test. These records shall be completed by <br />the employee's supervisor and forwarded to the Program Manager for inclusion <br />in the drug and alcohol files. These records shall also be made available to FTA <br />upon request. <br />ii. If a test for Controlled Substances is being requested, either on its own or in <br />addition to the Alcohol Test, it should be conducted within two hours. <br />10. Return to Duty Testing <br />a.
