AIA Document A133D - 2019 <br />Standard Form of Agreement Between Owner and Construction Manager as Constructor <br />where the basis of payment is the Cost of the Work Plus a Fee with a Guaranteed Maximum <br />Price <br />§ 6.1.4 Limitations, if any, on a Subcontractor's or the Construction Manager's self -performed <br />work overhead and profit for increases in the cost of its portion of the Work: <br />1 For each subcontractor, sub -subcontractor, or the Construction Manager's self -performed <br />work, for work performed by its own force, ten percent (10%) of that cost. <br />.2 For each subcontractor, or the Construction's Manager's self -performed work, for Work <br />performed by its subcontractors or sub -subcontractors, five percent (5%) of that cost. <br />.3 Costs to which overhead and profit are to be applied shall be determined in accordance <br />with Section 7.3.4 of A201-2017. <br />§ 6.1.5 Rental rates for Construction Manager -owned equipment shall not exceed the standard <br />rental rate paid at the place of the Project. <br />§ 6.1.6 Liquidated damages, if any: <br />(Insert terms and conditions for liquidated damages, if any.) <br />Not applicable. <br />§ 6.1.7 Other: <br />(Insert provisions for bonus, cost savings or other incentives, if any, that might result in a <br />change to the Contract Sum.) <br />Not applicable. <br />§ 6.2 Guaranteed Maximum Price <br />The Construction Manager guarantees that the Contract Sum shall not exceed the Guaranteed <br />Maximum Price set forth in the Guaranteed Maximum Price Amendment, subject to additions <br />and deductions by Change Order as provided in the Contract Documents. Costs which would <br />cause the Guaranteed Maximum Price to be exceeded shall be paid by the Construction Manager <br />without reimbursement by the Owner. Savings shall be shared 80% to the Owner and 20% to the <br />Construction Manager however the Construction Manager's savings share shall not exceed <br />$100,000. <br />§ 6.3 Changes in the Work <br />§ 6.3.1 The Owner may, without invalidating the Contract, order changes in the Work within the <br />general scope of the Contract consisting of additions, deletions or other revisions. The Owner <br />shall issue such changes in writing. The Construction Manager may be entitled to an equitable <br />adjustment in the Contract Time as a result of changes in the Work. <br />§ 6.3.1.1 The Architect may order minor changes in the Work as provided in Article 7 of AIA <br />Document A201-2017, General Conditions of the Contract for Construction. <br />IA Document A133 - 2019.
