<br />5. Rights of George E. Graham, whose interest in the subject
<br />property was purportedly divested by a tax deed recorded March
<br />22, 1993 as Instrument No. 9308853 in the Office of the
<br />Recorder of St. Joseph County, Indiana. In order to delete
<br />this exception, we require that proceedings to Quiet Title to
<br />said property against said party be filed in a court of
<br />competent jurisdiction, and proper service of process upon said
<br />party, a final Quiet Title judgment be entered therein, and the
<br />time within to file an appeal expire. In the alternative, we
<br />require that a quit -claim deed conveying title from George E.
<br />Graham to City of South Bend, Indiana/Board of Public Works be
<br />recorded in the Office of the Recorder of St. Joseph County,
<br />Indiana.
