&wieb Or 1 UScl c (.L)ACIcS <br />SUBSTITUTED RECIPROCAL AGREEMENT FOR EASEMENTS <br />This Agreement for Easements is dated July — LL, 2003, by and between the City of South <br />Bend, Indiana (the "City") and South Bend Christ Temple Church of God in Christ, Inc., (hereinafter <br />the "Church"). <br />WITNESSETH: <br />WHEREAS, Church is currently the owner of real estate located at 1214 South Michigan <br />Street, South Bend, Indiana; and <br />WHEREAS, City is the owner of certain real estate to the south of 1214 South Michigan <br />Street and more particularly described as follows: <br />A part of Lot 1 of Ivy Tech Minor Subdivision to the City of South Bend, a <br />subdivision in the Northwest Quarter of Section 13, Township 37 North, Range 2 <br />East, Portage Township, as recorded in Instrument No. 9750463 in the Office of the <br />Recorder of St. Joseph County, Indiana, described as follows: <br />Commencing at the intersection of the centerline of vacated Paris Street with the East <br />line of Michigan Street as shown on the recorded Plat of "Elder Place" as recorded <br />in the Office of the Recorder of St. Joseph County, Indiana; thence South 89' 4631" <br />East along said centerline and a line of said Lot I a distance of 195.31 feet; thence <br />South 00' 54' 54" West along a line of said Lot I a distance of 174.26 feet to the <br />Point of Beginning of this description; thence South 89' 51' 38" East a distance of <br />149.12 feet; thence South 00' 58' 42" West a distance of 353.37 feet to the most <br />Southern line of said Lot 1; thence South 89' 53' 18" West along said most Southern <br />Isle a distance of 123.33 feet; thence South 891 49' 27" West along said most <br />Southern line a distance of 214.36 feet to the East line of said Michigan Street; <br />thence North 00' 13' 30" East along said East line and a line of said Lot 1 a distance <br />of 355.05 feet to a line of said Lot 1; thence South 89' 51' 38" East along a line of <br />said Lot 1 a distance of 193.21 feet to the Point of Beginning and containing 2.764 <br />acres more or less: and <br />WHEREAS, the City will build a new central fire station on said property and will need <br />temporary right -of cnt:y through P. portion of tl�e property owned by Church for the purpose of <br />constructing said fire station; and <br />WHEREAS, once the constriction of the fire station is completed, the Church will need an <br />easement for ingress and egress onto its property, <br />NOW, THEREFORE, in consideration of the foregoing promises and for other good and <br />valuable consideration, receipt of which is hereby acknowledge, Church and City agree as follows: <br />1. Church shall grant to City so that it may construct the fire station a Temporary <br />Easement for Right -of- Entry, a copy of which is attached hereto as Exhibit "I" <br />
