Contractoragreesthathe/she/itshallenrollinandverifytheworkeligibilitystatusofallofContractor’snewlyhiredemployeesthroughtheE-VerifyProgramasdefinedbyIC.22-5-17-3.Contractor’sdocumentationofenrollmentandparticipationintheE-VerifyProgramisincludedandattachedaspartofthisbid/quote:and5.Contractorshallrequirehis/her/itssubcontractorsperformingworkunderthispubliccontracttocertifythatthesubcontractorsdonotknowinglyemployorcontractwithanunauthorizedalien,norretainanyemployeeorcontractwithapersonthatthesubcontractorsubsequentlylearnsisanunauthorizedalien.andthatthesubcontractorhasenrolledinandisparticipatingintheE-VerifyProgram.TheContractoragreestomaintainthiscertificationthroughoutthetermofthecontractwiththeCityofSouthBend,andunderstandsthattheCitymayterminatethecontractfordefaultiftheContractorfailstocureabreachofthisprovisionnolaterthanthirty(30)daysafterbeingnotifiedbytheCity.6.Persons,firms,partnerships,corporations,associations,orjointventurersawardedacontractbytheCityofSouthBendthroughitsagencies,boards,orcommissionsshallnotdiscriminateagainstanyemployeeorapplicantforemploymentintheperformanceofaCitycontractwithrespecttohire,tenure,terms,conditions,orprivilegesofcontractoremployment,oranymatterdirectlyorindirectlyrelatedtocontractingoremploymentbecauseofrace,sex,religion,color,nationalorigin,ancestry,genderexpression,genderidentity,sexualorientation,orduetoageordisabilitythatdoesnotaffectthatperson’sabilitytoperformthework.Inawardingcontractsforthepurchaseofwork,labor,services,supplies,equipment,materials,oranycombinationoftheforegoingincluding,butnotlimitedto,publicworkscontractsawardedunderpublicbiddinglawsorothercontractsinwhichpublicbidsarenotrequiredbylaw,theCity,itsagencies,boards,orcommissionswillconsidertheContractor’sgoodfaitheffortstoobtainparticipationbythosesubcontractorscertifiedbytheStateofIndianaasaMinorityBusiness(“MBE”)orasaWomen’sBusinessEnterprise(“WBE”)asafactorindeterminingthelowest,responsible,responsivebidder.ContractorsseekingtheawardofaCitycontractcannotberequiredtoawardasubcontracttoanN4WBE;however,theymaynotunlawfullydiscriminateagainstsaidMBE/WBE.Ongoal-eligiblecontracts,ContractorsarerequiredtoeithermeetbothMBEandWBEutilizationgoalsordemonstratethattheContractorhasmadegoodfaitheffortstoobtainparticipationfromMBEandWBEsubcontractors.AfindingofnoncomplianceoradiscriminatorypracticeshallprohibitthatContractorfrombeingawardedaCitycontractforaperiodofone(I)yearfromthedateofsuchdetermination,andsuchdeterminationmayalsobegroundsforterminatingthecontacttowhichthediscriminatorypracticeornoncompliancepertains.7.TheundersignedContractoragreesthatthefollowingnondiscriminationcommitmentshallbemadeapartofanycontractwhichitmayhenceforthenterintowiththeCityofSouthBend.Indianaoranyofitsagencies,boardsorcommissions.Contractoragreesnottodiscriminateagainstorintimidateanyemployeeorapplicantforemploymentintheperformanceofthiscontractwithprivilegesofemployment.oranymatterdirectlyorindirectlyrelatedtoemployment,becauseofrace,religion,color,sex,genderexpression,genderidentity,sexualorientation,handicap.nationaloriginorancestry.Breachofthisprovisionmayberegardedasmaterialbreachofcontract.I,theundersignedbidderoragentascontractoronapublicworksproject,understandmystatutoryobligationstotheuseofsteelproductsorfoundryproductsmadeintheUnitedStates(IC.5-16-8-I).IherebycertifythatIandallsubcontractorsemployedbymeforthisprojectwillusesteelproductsorfoundryproductsmadeintheUnitedStatesonthisprojectifawarded.IunderstandIhaveanaffirmativedutytonoti1itheCityinmybidthatmyproposaldoesnotincludetheuseofsteelproductsorfoundryproductsmadeintheUnitedStates.IunderstanditismysoleobligationandresponsibilitytoprovideajustificationtotheCity,subjecttoreviewandapproval.whythecostofUnitedStatesmadesteelorfoundryproductsisunreasonable.PriortoawardanduponsubmissionofbidwhichdoesnotusesteelproductsorfoundryproductsmadeintheUnitedStates,theCity,throughitsdirectorofpublicworks,shallmakeadeterminationifthepriceofUnitedStatesmadesteelorfoundryisunreasonable.IunderstandthatviolationshereunderVersion07/19/2023Contractor’sBidforPublicWorks-5
