REGULAR MEETING FEBRUARY 27, 1989 <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Council Chambers of the County -City Building on Monday, February 27, 1989, at 7:00 <br />p.m. The meeting was called to order and the Pledge to the Flag was given. <br />ROLL CALL Present: Council Members Luecke, Niezgodski, <br />Soderberg, Puzzello, Slavinskas, Zakrzewski, <br />Coleman, Duda and Voorde <br />Absent: None <br />REPORT FROM THE SUB - COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />The sub- committee has inspected the minutes of the February 13, 1989 meeting of the <br />Council and found them correct. <br />Therefore, we recommend the same be approved. <br />/s /Ann Puzzello <br />/s /John Voorde <br />Council Member Coleman made a motion that the minutes of the February 27, 1989, <br />meeting of the Council be accepted and placed on file, seconded by Council Member <br />Zakrzewski. The motion carried. <br />SPECIAL BUSINESS <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Committee of the Whole on February 27, 1989, at 7:05 p.m., with nine members <br />present. Chairman Luecke presiding. <br />BILL NO. 7 -89 A BILL ADOPTING THE PROVISIONS OF THE INDIANA CODE ADDRESSIN <br />THE ESTABLISHMENT OF A DEPARTMENT OF STORM WATER MANAGEMENT. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Niezgodski <br />indicated that the Utilities Committee and the Personnel and Finance Committee both <br />recommend the bill to the Council favorable. Council Member Slavinskas made the <br />presentation on the bill. He indicated that the proposed bill would establish a <br />Department of Storm Water Management for the City of South Bend, a State law passed <br />in 1987 authorizes the establishment of such a department. He indicated that <br />department would be responsible for providing for the collection and disposal of <br />storm water of the district in a manner that protects the public health and <br />welfare. Joe Guentert, 3510 Corby Blvd. spoke opposed to the bill. Council Member <br />Niezgodski made a motion to recommend this bill to the Council favorable, seconded <br />by Council Member Coleman. The motion carried. <br />BILL NO. 12 -89 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 2 OF THE MUNICIPAL CODE BY THE INCLUSION OF NEW <br />SECTION 2 -213 ENTITLED "SCHEDULE OF ORDINANCE AND CODE <br />VIOLATIONS" <br />Council Member Puzzello made a motion to continue this bill indefinitely, seconded <br />by Council Member Zakrzewski. The motion carried. <br />BILL NO. 13 -89 A BILL AMENDING CHAPTER 5 OF THE MUNICIPAL CODE OF THE CITY OF <br />SOUTH BEND, INDIANA, COMMONLY KNOWN AS "ANIMAL AND FOWL." <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Soderberg <br />stated that the Public Safety and Personnel & Finance Committee recommend this bill <br />to the Council favorably. Pat DeClercq, Director, Department of Code Enforcement, <br />made the presentation on the bill. She indicated that the intent of the bill is to <br />amend the fees authorized by Chapter 5 so that such fees more accurately reflect <br />the cost to the City of providing dog licensing and animal control services. The <br />amendment would give the city the option to contract with the St. Joseph County <br />Humane Society. The Humane Society would provide licenses also, in conjunction <br />with the City in hope that more pet owners might get their pets licensed. Dr. <br />Carol Ecker, President St. Joseph County Humane Society, 50871 Ironwood Rd., spoke <br />in favor of the bill. She indicated that the City of South Bend and the Humane <br />Society have been trying to work out some of the flaws in the ordinance, and this <br />is one step to do just that. Jacki Walorski -, Director St. Joseph County Humane <br />Society, spoke in favor of the bill. Joe Guentert, 3510 Corby Blvd. Blvd., had <br />several questions regarding the ordinance. Council Member Soderberg made a motion <br />to recommend this bill to the Council favorable, seconded by Council Member Duda. <br />The motion carried. <br />BILL NO. 14 -89 A BILL AUTHORIZING TAX ANTICIPATION TIME WARRANTS FOR 1989. <br />
