<br />indicated there would have to a maintained access to the property along Hull
<br />Street. Mr. Matteo indicated that when the street is vacated all the property owner
<br />will have to sign an agreement that will allow for perpetual access and that no
<br />structure can be built on the site. Council Member Voorde made a motion to
<br />recommend Bill No. 101 -88 to the Council favorable, subject to the easement
<br />agreement, seconded by Council Member Niezgodski. The motion carried. Council
<br />Member Slavinskas made a motion to recommend Bill No. 102 -88 to the Council

<br />BILL NO. 94 -88 A BILL AMENDING CHAPTER 9, ARTICLE 2 OF THE MUNICIPAL CODE OF THE

<br />MULTIPLE DWELLING UNITS AND RENTAL UNITS."

<br />BILL NO. 98 -88 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE
<br />EXPENSES OF THE CENTURY CENTER FUND OF THE CITY OF SOUTH BEND,
<br />INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1989 AND ENDING
<br />DECEMBER 31, 1989 INCLUDING ALL OUTSTANDING CLAIMS AND
<br />OBLIGATIONS AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Puzzello
<br />indicated the Personnel and Finance Committee and the Utilities Committee had met on
<br />this bill and recommended it to the Council favorably. Katherine Humphreys, City
<br />Controller, indicated this budget represent a 14% increase and reflects the
<br />increased cost of doing business at the convention facility. She indicated Century
<br />Center receives most of its operating expenses from the hotel -motel tax fund.
<br />Council Member Voorde made a motion to recommend this bill to the Council favorably,
<br />seconded by Council Member Luecke. The motion carried.

<br />Water Works budget reflects a 2.5 increase over this year. She indicated this bill
<br />should be amended as follows: reduce accounts 04261 and 04394 to zero in Clay
<br />Water; and increase account 04354 to $165,000 in Clay Sewage. Council Member Voorde
<br />made a motion to accept these amendments, seconded by Council Member Luecke. The
<br />motion carried. Joseph Guentert, 3510 Corby, spoke against this bill. Council
<br />Member Niezgodski made a motion to recommend this bill to the Council favorably, as
<br />amended, seconded by Council Member Coleman. The motion carried.
<br />BILL NO. 103 -88 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
<br />AMENDING VARIOUS SECTIONS OF CHAPTER 17 OF THE MUNICIPAL CODE OF
<br />THE CITY OF SOUTH BEND, COMMONLY KNOWN AS SEWERS AND WATER.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council member Voorde made a
<br />motion to accept the substitute bill on'file with the City Clerk, seconded by
<br />Council Member Coleman. The motion carried. Council Member Niezgodski indicated
<br />the Utilities Committee and the Personnel and Finance Committee had met on this bill
<br />and recommended it to the Council favorably. Jack Dillon, Director of Environmental
<br />Services, made the presentation for the bill. He indicated this increase in the
<br />rates will provide the City's portion for the funds to make improvements to the
<br />Wastewater Treatment Plant. He indicated that the City has received a grant for
<br />$13,754,325 from Federal and State environmental agencies. He indicated the new
<br />rates are structured on usage, and the minimum rate will now be $13.09. Joseph
<br />Guentert, 3510 Corby, spoke against this bill. Tom Brunette, 1216 King St., spoke
<br />against this bill. Irene Mutzl 320 Parkovash, spoke against this bill. Council
<br />Member Coleman made a motion to o amend this bill on page 25, "a" change the word
<br />change to charge, seconded by Council Member Puzzello. The motion carried. Council
<br />Member Voorde made a motion to recommend this bill to the Council favorably,
<br />seconded by Council Member Niezgodski. The motion carried.
