MEMORANDUM___ <br />Department of Community & Economic Development <br />Division of Planning & Neighborhood Development <br />to: Angie Jacob, Cler Board of Public Works <br />from: Larry Magliozzi <br />subject: Request to purchase pr perty from the City of South Bend- Key No. 18-7042-1661 <br />date: June 12, 1996 <br />The Division of Planning and Neighborhood Development has reviewed the aforementioned request <br />and offers the following comments. The petitioner has stated that he currently maintains the lot and <br />would like to acquire it for use as a side yard. He has also stated that the lot is used illegally as a <br />throughway by residents. Upon inspection, the lot does appear to occasionally be used as an <br />alleyway. There is not a curb cut allowing vehicular access to the lot, however, a Y x 5' service walk <br />remains. The lot is vacant, however, it may contain a house foundation underground. The 1994 <br />Southeast Neighborhood Strategic Action Plan encourages the development of vacant property <br />within the neighborhood to uses that are consistent with responsible home ownership. <br />Therefore, the Division of Planning and Neighborhood Development recommends the approval <br />of sale of said property to the petitioner. <br />The approval of sale should be conditional, and the following conditions should be reflected in the <br />deed: <br />1. The lot, individually, cannot be used as a building site for purposes of a new, single- <br />family construction site. <br />2. Petitioner should combine the two tax key numbers (18-7042-1662 and 18-7042-1661) <br />through the procedures of the Township Assessor's office. <br />However, the lot can be used for structural expansion of the residence at 215 Dayton or new garage <br />construction, following current zoning requirements. <br />Jopl�.
