y <br />JUNE 13, 1988 <br />REGULAR MEETING <br />ESTABLISHING AN ENHANCED EMERGENCY TELEPHONE SYSTEM FEE <br />WHEREAS, Indiana Code 36 -8 -16 authorizes the fiscal body of a county to adopt an <br />ordinance to impose an Enhanced Emergency Telephone System Fee to provide the <br />funding for a countywide Enhanced Emergency Telephone System utilizing the three <br />digit number 9 -1 -1 to send automatic number identification and automatic location <br />identification for reporting police, fire, medical, or other emergency situations; <br />and <br />WHEREAS, the city of South Bend, the city of Mishawaka, and St. Joseph County <br />presently have functioning Enhanced Emergency Telephone Systems that serve and <br />benefit all of the citizens of St. Joseph County; <br />WHEREAS, it would be desirable for the St. Joseph County Council to adopt an <br />ordinance establishing a uniform fee for all service users in this county pursuant <br />to State law; and <br />WHEREAS, the system should include all necessary Enhanced Emergency Telephone <br />equipment such as computer hardware, software, and data base provisioning, as well <br />as secondary public safety answering points for the South Bend Fire and Police <br />Departments and the St. Joseph County Fire Dispatch; and <br />WHEREAS, the system should include all telephone service suppliers in St. Joseph <br />County; <br />NOW, THEREFORE, BE IS RESOLVED BY THE Common Council of the city of South Bend, <br />Indiana, as follows: <br />SECTION I. The City of South Bend through its Common Council hereby petitions the <br />St. Joseph County Commissioners and the St. Joseph County Council to enact an <br />ordinance for a countywide emergency telephone system fund that will process fees of <br />service users. <br />SECTION II. The Common Council acknowledges that the fees would be used to pay <br />for the lease, purchase, and maintenance of all Enhanced Emergency Telephone <br />equipment necessary to provide a quality Enhanced Emergency Telephone System on a <br />countywide basis, including all of the provisions currently under contract by the <br />city of South Bend, the city of Mishawaka, and St. Joseph County, as well as the <br />anticipated additional services. <br />SECTION III. Upon adoption of this Resolution, the Common Council directs the <br />City Clerk to send copies to the County Commissioners and to the President of the <br />County Council of St. Joseph County. <br />SECTION IV. This Resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />/s/ John Voorde <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Council Member Voorde <br />made the presentation for the resolution. He indicated this resolution would <br />petition the Commissioners and Council Council to adopt an ordinance establishing an <br />enhanced Emergency Telephone System Fee. He indicated pursuant to State law the <br />fiscal body of the county may adopt an ordinance imposing a monthly fee, and if the <br />county does not adopt such an ordinance the legislative body of a city within the <br />county may petition the county to adopt such an ordinance. He indicated the <br />attached resolution would formally petition the county to adopt such an ordinance. <br />Joseph Guentert, 3510 Corby, questioned the amount of the fee. Council Member <br />Voorde indicated it would be 22 cents per customer. Council Member Coleman made a <br />motion to adopt this resolution, seconded by Council Member Slavinskas. The <br />resolution was adopted by a roll call vote of nine ayes. <br />BILLS, FIRST READING <br />BILL NO. 39-88 LANDLMARK AMENDING ROPERTY LOCATED AT 929 E.DMILTON, INI THE ACITYSOFRIC <br />SOUTH BEND, INDIANA. <br />This bill had first reading. Council Member Puzzello made a motion to refer this <br />bill to Area Plan, seconded by Council Member Luecke. The motion carried. <br />BILL NO. 40 -88 LLND ANNEXING CITY LIMITS OF <br />SE <br />BENDIANA,CERTAN LAND LOCATED IN PENN TOWNSHIP, ST. JOSEPH <br />COUNTY, INDIANA. <br />This bill had first reading. Council Member Puzzello made a motion to set this bill <br />for second reading and public hearing June 27, and refer it to the Zoning and <br />Vacation Committee, seconded by Council Member Coleman.
