241 <br />-. �e- <br />�I � <br />WHEREAS, the Federal Water Pollution Control Act (P.L. 92 -500) as amended by the <br />Clean Water Act of 1977 (P.L. 95 -217) requires the development and implementation of <br />water quality management plans for the purpose of preventing further degradation of <br />— our streams; and <br />WHEREAS, pursuant to Section 208 and 303(e) of the Act, the Governor of the <br />State of Indiana has designated the Stream Pollution Control Board as the state <br />agency responsible for water quality management; and <br />WHEREAS, pursuant to Section 208, the Stream Pollution Control Board designates <br />specific local units of government and management agencies for the purpose of <br />implementing various pollution control measures and practices recommended in the <br />State's Water Quality Management Plan; and <br />WHEREAS, a process exists by which all municipal units of government and special <br />districts who intend to abate pollution may enter into the Construction Grants <br />process for the purpose of constructing wastewater treatment facilities; and <br />WHEREAS, the municipality of South Bend, Indiana, desires to abate water <br />pollution within its area of legal jurisdiction; and <br />WHEREAS, the municipality of South Bend, Indiana, further desires to be in <br />compliance with the requirements for obtaining Federal funding for the purpose of <br />this control; and <br />WHEREAS, the Environmental Protection Agency, Region V, has directed that only a <br />certified and approved designated management agency can be the recipient of a 201 <br />municipal facilities construction grant award. <br />WHEREAS, it was necessary for then Mayor Roger O. Parent on December 31, 1987, <br />to sign an Executive Order designating the South Bend Wastewater Board of <br />Commissioners to be the certified and approved designated management agency for the <br />control of water pollution sources within its area of legal jurisdiction. <br />THEREFORE, by this Resolution, the Common Council of the City of South Bend, <br />Indiana, ratifies the actions of then Mayor Roger O. Parent on December 31, 1987, in <br />his Executive Order and states its desire that the South Bend Wastewater Board of <br />Commissioners be the certified and approved designated management agency for the <br />control of water pollution sources within its area of legal jurisdiction. <br />This resolution shall be in full force and effect upon its passage and its <br />approval by the Mayor. <br />By Resolution passed by the South Bend Common Council at its meeting this 4TH <br />day of January, 1988. <br />/s /John Voorde <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. John Leszczynski, City <br />Engineer, indicated this resolution ratifies the actions of Mayor Roger Parent on <br />December 31, 1987, in his Executive Order and states its desire that the South Bend <br />wastewater Board of Commissioners be the certified and approved designated <br />management agency for the control of water pollution sources within its area of <br />legal jurisdiction. Council Member Zakrzewski made a motion to adopt this <br />resolution, seconded by Council Member Coleman. The resolution was adopted by a <br />roll call vote of nine ayes. <br />There being no further business to come before the Council, unfinished or new, <br />Council Member Niezgodski made a motion to adjourn, seconded by Council Member <br />Zakrzewski.
