203 <br />A public hearing was held on the resolution at this time. Council Member Braboy <br />read the resolution and presented it to Gladys Muhammad. Council Member Taylor made <br />a motion to adopt the resolution, seconded by Council Member Beck. The resolution <br />was adopted by a roll call vote of eight ayes. <br />REPORTS <br />Council Member Voorde indicated that the Zoning and Vacation Committee had met on <br />Bill Nos. 97, 124, 125 -87; 115 -87 will be continued until December 21. <br />He indicated <br />the other bills received a favorable recommendation. <br />Council Member Braboy indicated the Human Resources Committee had met on <br />Bill No. <br />128 and 132 -87 and they received a favorable recommendation. <br />Council Member Puzzello indicated the Committee of the Whole had met on <br />Bill No. <br />67 -87, and it was sent to the Council with no recommendation. <br />Council Member Barcome indicated the Utilities Committee had met on Bill <br />No. 129 and <br />130 -87, and they were sent to the Council with no recommendation. <br />Council Member Barcome indicated the Personnel and Finance Committee had <br />met on Bill <br />No. 133 -87 and it received a favorable recommendation. <br />Council Member Braboy made a motion to resolve into the Committee of the <br />Whole, <br />seconded by Council Member Zakrzewski. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Committee of the Whole on December 7, at 4:18 p.m., with nine members present. <br />Chairman Puzzello presiding. <br />BILL NO. 97 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1918 <br />EDISON ROAD IN THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Kevin Joyce, from Area Plan, <br />gave the staff report. He indicated this bill was sent to the Council with no <br />recommendation. Tony Zappia, attorney for the petitioner, made the presentation for <br />the bill. He indicated they were requesting "b" zoning for this property, in order <br />for Dr. Sergio, to move out of his office. He indicated the doctor's practice is <br />limited to periodontics and sees approximately six patients a day, therefore, there <br />would be no increase of traffic in the area. He indicated the office was completely <br />remodeled and was an asset to the neighborhood. He read two letters from the <br />immediate next door neighbors George and Lillian Ambler and Ross Mittiga, indicating <br />Dr. Sergio has been a good neighbor and has upgraded the property. Chris Winter, <br />spoke against this rezoning. He indicated that "B" zoning Dr. Sergio to bring <br />another doctor into the office, and he could rent apartments to students. He <br />indicated that the doctor does not reside at this office. He indicated that the "B" <br />zoning would allow Dr. Sergio to sell the property to anyone who would qualify under <br />that zoning. Bob Mulderink, 1516 Harrington Dr., spoke against this zoning. He <br />indicated there was a traffic problem in the area now. Art James, 2007 E. Edison, <br />spoke against this zoning. Tony Zappia, indicated the doctor does live at 1918 <br />Edison. He indicated the doctor only sees approximately six patients a day <br />therefore the traffic would not be increased. He indicated the office and parking <br />lot are not large enough to accommodate another doctor. Dr. Sergio indicated he <br />receives referrals from other dentists and could not have another dentist in his <br />office. The Council concluded that no alterations could be made to this property <br />without approval of Area Plan. Council Member Beck made a motion to recommend this <br />bill to the Council favorably, seconded by Council Member Barcome. The motion <br />carried on a roll call vote of six ayes and two nays (Council Members Zakrzewski and <br />Voorde.) <br />BILL NO. 115 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: DINAN COURT, <br />RUNNING WEST FROM ST. JOSEPH STREET APPROXIMATELY 165 FEET TO THE <br />FIRST NORTH -SOUTH ALLEY WEST OF ST. JOSEPH STREET. ALSO, THE <br />FIRST EAST -WEST ALLEY NORTH OF NAVARRE STREET FROM ST. JOSEPH <br />STREET WEST APPROXIMATELY 165 FEET TO THE FIRST NORTH -SOUTH ALLEY <br />WEST OF ST. JOSEPH STREET. ALSO, THE FIRST EAST -WEST ALLEY NORTH <br />OF NAVARRE STREET FROM MICHIGAN STREET EAST APPROXIMATELY 165 <br />FEET TO THE FIRST NORTH -SOUTH ALLEY WEST OF ST. JOSEPH STREET. <br />Council Member Voorde made a motion to continue public hearing on this bill until <br />December 21, seconded by Council Member Serge. The motion carried. <br />BILL NO. 124 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: GARST ST. <br />RUNNING WEST FROM THE WESTERLY RIGHT -OF -WAY OF PRAIRIE TO THE 1ST <br />NORTH -SOUTH ALLEY FOR A DISTANCE OF 143.54' MORE OR LESS. ALL <br />BEING PART OF SOUTH BEND CITY ADD., WITHIN THE CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard.
