RESOLUTION NO. 3631 <br />A RESOLUTION OF THE SOUTH BEND <br />REDEVELOPMENT COMMISSION <br />ACCEPTING THE TRANSFER OF REAL PROPERTY FROM <br />THE CITY OF SOUTH BEND, ACTING THROUGH ITS BOARD OF PUBLIC WORKS <br />WHEREAS, the City of South Bend, acting through its Board of Public Works (the <br />“City”) is the owner of certain property identified herein; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City, may transfer or exchange property <br />with another governmental entity upon terms and conditions agreed upon by the two (2) entities <br />as evidenced by the adoption of substantially identical resolutions of each entity; and <br />WHEREAS, the South Bend Redevelopment Commission (the “Commission”), the <br />governing body of the South Bend, Indiana, Department of Redevelopment (the “Department”) <br />exists and operates under the provisions of I.C. 36-7-14, as amended from time to time (the <br />“Act”) and is a body corporate and politic; and <br />WHEREAS, the City desires to the transfer to the Commission certain real property as <br />set forth in Exhibit “A” attached (collectively referred to as the “Property”); and <br />WHEREAS, the Commission desires to accept the transfer of the Property from the City <br />for purposes of redevelopment and; <br />WHEREAS, the City has adopted a resolution consistent with the requirement of Indiana <br />§ 36–1–11–8. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT COMMISSION AS FOLLOWS: <br />1.The transfer of the following described real property situated in St. Joseph County, <br />Indiana: <br />See Exhibit “A” <br />by the City to the Commission, without consideration, shall be, and hereby is, approved and <br />authorized. <br />2.The Director of Redevelopment for the City of South Bend shall cause the <br />recording of a quit claim deed conveying all the right, title and interest of the South Bend <br />Redevelopment Commission in and to the Property, for the use and benefit of its Department of <br />Redevelopment. <br />3.This Resolution shall be in full force and effect upon its adoption.
