REGULAR MEETING
<br />AUGUST 23, 1993
<br />Be it remembered that the Common Council of the City of South Bend met in the Council
<br />Chambers of the County -City Building on Monday, August 23, 1993, at 7:00 p.m. The
<br />meeting was called to order and the Pledge to the Flag was given.
<br />ROLL CALL Present: Council Members Luecke, Washington, Kelly,
<br />Puzzello, Slavinskas, Zakrzewski, Coleman, Duda
<br />and Ladewski
<br />Absent: None
<br />REPORT FROM THE SUB - COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />The sub - committee has inspected the minutes of the July 29, August 1, August 9, 1993,
<br />meetings of the Council and found them correct.
<br />Therefore, we recommend the same be approved.

<br />Council Member Coleman made a motion that the minutes of the July 29, August 1 and
<br />August 9, 1993, meetings of the Council be accepted and placed on file, seconded by
<br />Council Member Duda. The motion carried.
<br />SPECIAL BUSINESS
<br />Richard Nussbaum, City Attorney, gave a report on the Legal Department's roll in
<br />enforcement of City ordinance violations.
<br />Council Member Coleman made a motion to resolve into the Committee of the Whole,
<br />seconded by Council Member Zakrzewski. The motion carried.
<br />COMMITTEE OF THE WHOLE
<br />Be it remembered that the Common Council of the City of South Bend met in the
<br />Committee of the Whole on August 23, 1993 at 7:30 p.m., with nine members present.

<br />BILL NO. 47 -93 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 135 EAST
<br />IRELAND ROAD, IN THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill proponents
<br />and opponents were given an opportunity to be heard. Council Member Slavinskas
<br />reported that the Zoning and Vacation Committee had met on this bill and recommended
<br />it to the Council unfavorable. John Byorni, Area Plan, gave the Commission report,
<br />which was favorable, subject to a curb cut on Norman. Richard Morgan, Attorney, made
<br />the presentation for the bill. He indicated the petitioners were willing to amend
<br />this bill, subject to a curb cut on Norman Street controlled by a gate that would
<br />only allow delivery trucks to exit. Council Member Kelly indicated the petitioners
<br />were clients of Society Bank, but voting on this issue would not constitute a
<br />conflict of interest. Council Member Slavinskas made a motion to amend Section II,
<br />by adding a sentence to read "Subject to a curb cut on Norman Street controlled by a
<br />gate allowing only the exit of delivery trucks during the hours of 8:00 a.m. to 6:00
<br />p.m. ", seconded by Council Member Puzzello, the motion carried. Joe Wilk, 139 E.
<br />Norman, indicated his sons, who live on Norman St., wanted this zoning to pass, but
<br />he had reservations. Della Curtis, 149 E. Ireland, indicated she was opposed to this
<br />zoning due to the increased traffic on Ireland. Mr. Morgan, attorney, indicated the
<br />gate will prevent traffic from going on to Norman. Council Member Slavinskas made a
<br />motion to recommend this bill to the Council favorable, as amended, seconded by
<br />Council Member Kelly. The motion carried.
<br />BILL NO. 65 -93 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1131 W.
<br />WASHINGTON IN THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill proponents
<br />and opponents were given an opportunity to be heard. Council Member Slavinskas
<br />reported that the Zoning and Vacation Committee had met on this bill and recommended
<br />it to the Council favorable. John Byorni, Area Plan, gave the Commission report,
<br />which was favorable. Adeline Jones, 1131 W. Washington, made the presentation for
<br />the bill. She indicated this property was used as a barber shop and convenience
<br />store and it was grandfathered in for that use in an A- residential area. She
<br />indicated she talked with South Bend Heritage about adding a food service facility
<br />with a drive through area; and after getting a loan and having the driveway poured
<br />they applied for a permit to upgrade the kitchen and found they were not zoned
<br />property. Dea Andrews, 223 S. Scott, spoke in favor of the zoning. Eugenia Braboy,
<br />1028 W. Colfax, indicated this would be an asset to the neighborhood. Don Grandison,
<br />50614 Linden Grove, indicated he owned property in the neighborhood and was in favor
<br />of the zoning; he said he was speaking for Clark Funeral Home who was in favor of
<br />the rezoning. William Ellison, 1008 W. Colfax and Louvenia Cain, 1207 W. Colfax,
<br />spoke in favor of the rezoning. Council Member Slavinskas made a motion to recommend
<br />this bill to the Council favorable, seconded by Council Member Ladewski. The motion
<br />carried.
<br />BILL NO. 67 -93 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -
<br />WEST ALLEY SOUTH OF NAVARRE STREET, RUNNING WEST FROM THE WEST LINE OF
<br />
