<br />THIS INDENTURE made this /L day of , 002, by and between
<br />Dale E. and Rosalie A. Woodcox of 494 E. Michigan Street of 939 New Carlisle IN
<br />(Grantor), and the Civil City of South Bend, Indiana, by and through its Board of Public Works
<br />(Grantee), in favor of the Civil City of South Bend, its successors and assigns.
<br />WITNESSETH:
<br />Grantor is the fee owner of the following described real estate:
<br />A parcel of land located in the West %z of the Northwest 1/4 of Section 36, Township 37 North, Range 2
<br />East, Center Township, City of South Bend, St. Joseph County, Indiana, and described as follows:
<br />Commencing at the intersection of the South right of way line of Johnson Road and the East right of way
<br />line of Main Street; thence South along said East line of Main Street, 236.88 feet to the North line of Lot 37, Ritters
<br />Dixie Gardens Subdivision (unrecorded) and the place of beginning; thence continuing South along said East line of
<br />Main Street, 100 feet; thence East along the South line of said Lot 37, paraIlel with said South line of Johnson Road,
<br />156.4 feet; thence North parallel with said East line of Main Street, 100.01 feet; thence West along the North line of
<br />said Lot 37, 160.07 feet to said East line of Main Street and the place of beginning. Containing 0.363 acres, more or
<br />less and being commonly known as 5614 S. Main Street, Tax Key #23-1017-0340.23.

<br />NOW, THEREFORE, for good and valuable consideration, the receipt of which Grantor
<br />hereby acknowledges, Grantor hereby grants, conveys, and warrants to Grantee a permanent
<br />easement on a portion of the above described fee realty of the nature and at the specific location
<br />hereinafter set forth and described below, for the installation and construction of a sanitary sewer
<br />and water system and related facilities, together with the right of ingress to and egress from said
<br />easement for the purpose of installing and constructing said system and other equipment or
<br />facilities incidental thereto. The property subject to the subject easement as to which Grantee
<br />shall have full rights in, upon, over and under, is located in the City of South Bend, St. Joseph
<br />County, State of Indiana, and is described more particularly as follows:
<br />A strip of land located in the West %z of the Northwest V4 of Section 36, Township 37 North, Range 2 East,
<br />Center Township, City of South Bend, St. Joseph County, Indiana, and described as follows:
<br />Beginning at the Northwest corner of Lot 37, Ritters Dixie Gardens Subdivision (unrecorded); thence East
<br />along the South line of said Lot 37, 160.07 feet to the East line of said Lot 37; thence South parallel with
<br />the East line of Main Street, 10.0 feet; thence West, parallel with said North line of Lot 37, 160.07 feet,
<br />more or less, to the East right of way line of Main Street; thence North along said East line of Main Street,
<br />10.0 feet to the place of beginning.
