PROCEDURE 2 <br />Request from interested property owner whose property is adjacent to the property that is being <br />requested for purchase (Value of vacant lot less than $5,000.00). <br />A. Board receives request from interested property owner whose own property is adjacent to <br />the property that is being requested for purchase. <br />B. Clerk of the Board sends a request for recommendations to: <br />1. City Engineer <br />2. Parks Department <br />3. Conununity Development (CD) <br />4. Legal Department (Legal) <br />5. Code Enforcement <br />6. Others as needed <br />C. CD recommendation, if favorable, includes the following: <br />1. Determination of lot valuation. If assessment at or above $2,000.00, CD requests <br />Township Assessor for reduced assessment. <br />2. Prepare Sale of Property form which establishes sale price. <br />3. Determination of the following: <br />- highest and best use of parcel is sale to abutting owner <br />- cost of maintenance to public equals or exceeds estimated fair market value <br />- economically unjustifiable to sell the parcel through regular bid process <br />4. informs property owner what the offering price will be; solicits from property owner <br />that offering price is acceptable. <br />D. Clerk receives recommendations. Forwards to Mayor. <br />E. Upon Mayoral approval, Board grants permission to advertise. <br />F. Clerk prepares Notice to Bidders and Notice to Adjacent Property Owners. <br />G. Board advertises sale of vacant property. Letters to adjacent owners. <br />H. Sealed bids received from adjacent property owners. <br />I. Determination of sale of lot to appropriate bidder (may not be to property owner who had <br />initial interest). Please consult State law if more than one bidder. <br />J. Clerk prepares Purchase Agreement and Award Letter. Sends to successful bidder. <br />K. Clerk receives Purchase Agreement and payment from successful bidder. <br />L. Clerk informs Legal to prepare deed. <br />M. Clerk records deed. <br />N. Notification to CD so City -Owned Property List can be changed. <br />O.
