Kathleen Roemer, Controller <br />City of South Bend <br />1400 County -City Building <br />South Bend, IN 46601 <br />QUIT CLAIM DEED <br />THIS INDENTURE WITNESSETH, that the City of South Bend, Department of <br />Redevelopment, in St. Joseph County, Indiana ("Grantor"), conveys and quit claims to Civil City <br />of South Bend ("Grantee"), for and in consideration of One and 00/100 Dollars (S1.00), the receipt <br />of which is hereby acknowledged, the following described real estate in the City of South Bend, St. <br />Joseph County, Indiana ("Real Estate"): <br />Lot lettered "A" as shown on the recorded Plat of Leighton Plaza Re -plat of the <br />City of South Bend Original Plat recorded June 15,1999 as Document Number <br />9927350 in the Office of the recorder of St. Joseph County, Indiana. <br />Subject to all covenants, easements and restrictions of record and to a Ground Lease between <br />the City of South Bend and Memorial Hospital of South Bend, Inc. dated January 23, 1998 and a <br />Ground Lease between the City of South Bend and Riggs & Company, a division of Riggs Bank, <br />N.A., as Trustee of the Multi -Employer Property Trust dated March 6, 1998, and leases with tenants <br />of the commercial rental space on Michigan Avenue, which Ground Leases and leases are not <br />assigned to or assumed by South Bend Public Transportation, Inc. and also subject to the Land Use <br />Plan recorded by Grantor and other agreements of record with Grantor affecting the property. <br />The building known as the Memorial Leighton Health♦Plex Building and the building <br />known as the Multi -Employer Property Trust Building, and the elevators exclusively serving those <br />respective buildings are not owned by Grantor and are not conveyed by this deed. <br />Grantor certifies that this conveyance iz not subject to Indiana Gross Income Taxes or <br />Indiana Adjusted Gross Income Taxes. <br />IN WITNESS WHEREOF, the Grantor has caused this Deed to be duly executed in its behalf <br />by Jon R.
