Dear Ms. Jacobs: <br />This letter is to request a formal release of Utility easement rights within a previously vacated Dunham <br />Street and adjacent Vacated Alleys within the Plat of "Dunham's Subdivision of the North part of Bank <br />Outlot it 78" located on the West side of Chapin Street approximately 650 feet North of Sample Street in <br />South Bend, Indiana. The site is the present location of an existing truck facility which lies South of the <br />Oliver Plow Works property. Our clients, the City of South Bend, are in the process of reconfiguring the <br />property shown on the attached survey and the Oliver Plow Works site into a Major Subdivision with <br />several lots for industrial users. As part of the City's Subdivision procedure, the owner is required to <br />subdivide the existing parcels of ground and the Vacated Street and Vacated Alleys into legal lots of record <br />for building purposes. On the attached survey drawing, we have highlighted the existing Vacated Street and <br />Alleys. The Area Plan Commission is requesting that as part of the Major Subdivision procedure, we have <br />from each Utility company or governing authority, a letter releasing any easement rights they may have to <br />the shown Vacated Street and Vacated Alleys. I have also attached a copy of the sample wording the Area <br />Plan Commission has used in the past for such release letters. <br />If you have any questions conceming this matter, please feel free to give me a call at 234-4003. <br />Sincerely, <br />Michael J.
