BODNAR <br />ASSISTANT CITY ATTORNEY <br />RE: DISANNEXATION <br />w e" <br />DATE: December 10, 2001 <br />The pertinent statute here, IC 36-4-3-17 gives us no guidance other than to do what is "just <br />and equitable". There has not been a case interpreting the statute since at least 1935, so we cannot look to <br />case law for guidance. <br />The first thing to note here is that notice must be given in accordance with IC 5-3-I. IC 5- <br />3-1-2(b) states that notice must be given one (1) time, at least ten (10) days before the hearinID <br />g.
