440 <br />REGULAR MEETING <br />NOVEMBER 23, 1992 <br />BILL NO. 91 -92 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST <br />EAST -WEST ALLEY SOUTH OF LINCOLN WAY WEST FROM THE WEST <br />RIGHT -OF -WAY LINE OF N. WALNUT TO THE EAST RIGHT -OF -WAY LINE OF <br />THE FIRST INTERSECTING NORTH -SOUTH ALLEY WEST OF N. WALNUT; AND <br />THE FIRST NORTH -SOUTH ALLEY WEST OF N. WALNUT FROM THE SOUTH <br />RIGHT -OF -WAY OF LINCOLN WAY WEST TO THE NORTH RIGHT -OF -WAY LINE <br />OF THE FIRST INTERSECTION EAST -WEST ALLEY SOUTH OF LINCOLN WAY <br />WEST. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />reported that the Zoning and Vacation Committee had met on this bill and recommended <br />it to the Council favorable. James Millsap, Deacon of the Faith Apostolic Temple, <br />made the presentation for the bill. He indicated the church was requesting this <br />vacation in order to provide for additional parking. Council Member Luecke made a <br />motion to recommend this bill to the Council favorable, seconded by Council Member <br />Coleman. The motion carried. <br />BILL NO. 92 -92 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: A 14 -FOOT <br />ALLEY LYING BETWEEN CLOVER ROAD AND OAKLAND STREET, A LENGTH OF <br />APPROXIMATELY 361.00 FEET, MEASURED EAST /WEST AND 14.00 FEET, <br />MEASURED NORTH - SOUTH, SITUATED SOUTH OF LOTS 1 THROUGH 5, 78 AND <br />79, ALL INCLUSIVE OF HIBBERD PLACE, SAID SUBDIVISION BEING A PART <br />OF THE EAST HALF OF THE NORTHWEST QUARTER OF SECTION 18, TOWNSHIP <br />37 NORTH, RANGE 3 EAST, PORTAGE TOWNSHIP, CITY OF SOUTH BEND, ST. <br />JOSEPH COUNTY, INDIANA. <br />Council Member Luecke made a motion to accept the substitute bill on file with the <br />City Clerk, seconded by Council Member Coleman. The motion carried. Council Member <br />Luecke made a motion to continue public hearing on this bill until December 14, <br />seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 93 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AUTHORIZING THE ACQUISITION AND CONSTRUCTION OF EXTENSIONS, <br />ADDITIONS AND IMPROVEMENTS TO THE MUNICIPAL WATERWORKS OF THE <br />CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE OF REVENUE <br />BONDS TO PROVIDE FOR THE COSTS THEREOF, AND AUTHORIZING THE <br />COLLECTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF SUCH <br />WATERWORKS AND OTHER RELATED MATTERS. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. There was no committee meeting <br />held on this bill. Randy Ropola, attorney, made the presentation for the bill. He <br />indicated this bond issue would be for a maximum of 5.1 million, with a maximum <br />interest rate of 10.5 %. He indicated this bond would be used to finance a new <br />office for the water Works, as well as other upgrades needed at the Water Works, and <br />will be repaid from revenue gained by the proposed rate increase. T. Brooks <br />Brademas, 425 N. Michigan, indicated the Robertson's Building should be used for a <br />government building and the Water Works could be housed at that location, as well as <br />other departments that need space. He indicated the Building Department, and the <br />Economic Development Department were renting space in the First Bank Building. <br />Joyce Boaler, spoke against the bill. Council Member Luecke indicated there was a <br />committee studying the feasibility of using the Robertson's Building for government <br />offices. Council Member Luecke made a motion to recommend this bill to the Council <br />favorable, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 94 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF <br />THE DESIGNATED ENTERPRISE FUNDS OF THE CITY OF SOUTH BEND, <br />INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1993, AND <br />ENDING DECEMBER 31, 1993, INCLUDING ALL OUTSTANDING CLAIMS AND <br />OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Luecke made a <br />motion to accept amended pages 2 -10 through 2 -12, Water Works, 4 -2 through 4 -5 Solid <br />Waste, seconded by Council Member Zakrzewski. The motion carried. Council Member <br />Luecke made a motion to reserve further action on pages 8 -1 through 8 -7 for Century <br />Center, seconded by Council Member Zakrzewski. The motion carried. Council Member <br />Puzzello reported that the Utilities and Personnel & Finance committees had met on <br />this bill and recommended it to the Council favorable, as amended. Kevin Horton, <br />Controller, made the presentation for the bill. He indicated this bill would <br />appropriate budgets for the enterprise funds for 1993. He indicated Solid Waste and <br />Water Works are subject to future rate increases. The Solid Waste budget is for the <br />implementation of city -wide trash service. There will be a rate change for Solid <br />Waste that will come before the Council over the next 4 to 6 weeks. If the Council <br />approves this particular increase then there will be a modified Solid Waste budget <br />that will be predicated on the current budget plus whatever personnel increases that <br />are anticipated. Joyce Boaler, spoke against the citywide trash proposal. Council <br />Member Luecke made a motion to recommend this bill to the Council favorable, as <br />amended, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 95 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />APPROPRIATING $188,000.00 FROM THE MORRIS CIVIC CAPITAL <br />IMPROVEMENT FUND. <br />
