01 ' <br />OF IRELAND AND MIAMI ROADS, SOUTH BEND, INDIANA, TO BE AN <br />ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A TEN YEAR REAL <br />PROPERTY TAX ABATEMENT FOR MASSACHUSETTS MUTUAL LIFE <br />INSURANCE COMPANY /SCOTTSDALE MALL. <br />WHEREAS, the Common Council of the City of South Bend, Indiana has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic <br />Revitalization Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as <br />Southeast Corner of Ireland and Miami Road, South Bend, and which is more <br />particularly described as follows: <br />A parcel of real estate in the County of St. Joseph, State of Indiana and <br />described as follows: <br />A parcel being part of the North Half of the Southwest Quarter of Section 30, <br />Township 37 North, Range 3 East, City of South Bend, Centre Township, St. Joseph <br />County, Indiana, described as follows: Commencing at the Northwest corner of <br />said quarter; thence South 89 °54137" East (bearing assumed) along the North <br />line of said quarter, a distance of 260.00 feet to the point of beginning; <br />thence continuing along said North line a distance of 1052.00 feet, thence South <br />00 °05'11" West, a distance of 870.00 feet; thence North 89 °59116" East a <br />distance of 53.00 feet; thence South 00 °04132" West a distance of 150.00 feet; <br />thence South 89 °55120" East, to the West line of Scottsdale Addition, Section <br />"A" a distance of 484.86 feet; thence South 00 °25'08" East, along said West <br />line to the North right -of -way of U.S. Route 20 by pass, a distance of 156.52 <br />feet; the next (8) calls being on the North said right -of -way; thence Deed; <br />South 60 °58100" West, a distance of 421.39 feet, (measured: South 70 °28'36" <br />West, 313.64 feet and South 70 °27131" West, 106.22 feet) to the South line of <br />said North Half; thence along said North line, North 89 °52'45" West, a <br />distance of 1397.83 feet; thence North 0 °05'50" East, along the East side of a <br />tract purchased by I.D.O.T. for right -of -way line(county), a distance of 19.84 <br />feet; thence along the said East right -of -way line South °04121" East, a <br />distance of 1788.69 feet; thence North 89 °52145" West, a distance of 40.00 <br />feet to the West line of said quarter section; thence North 00 °00100" East, <br />along said West line a distance of 1046.67 feet; thence Deed: South 89 °54126" <br />East, a distance of 260.00 feet, thence North 00 °00'00" East, a distance of <br />270.00 feet to the point of beginning. <br />with said real estate having the following Rey Number 231009 -0582, 231009- 0582B, <br />231009- 0582C, as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public <br />hearing before the Council has been published pursuant to Indiana Code <br />6- 1.1- 12- .1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />Now, therefore, be it resolved by the Common Council of the City of South Bend, <br />Indiana, as follows. <br />Section I. The Common Council hereby confirms its Declaratory Resolution <br />designating the area described herein as an Economic Revitalization Area for the <br />purposes of tax abatement. Such designation is for Real Property tax abatement only <br />and is limited to two (2) calendar years from the date of adoption of the <br />Declaratory Resolution by the Common Council. <br />Section II. The Common Council hereby determines that the property owner is <br />qualified for and is granted real property tax deduction for a period of ten (10) <br />years, and further determines that the petition complies with Chapter 2, Article 6, <br />of the Municipal Code of the City of South Bend and Indiana Code 6 -1.1 -12.1 et seq. <br />Section III. This Resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />/s/ Stephen Luecke <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Ernest Szarwark, <br />attorney, made the presentation for the resolution. He indicated the new owners are <br />planning to do $3.5 million dollars worth of interior and exterior improvements, <br />which will include new escalators, landscaping, construction of a six screen movie <br />theater and a food court. Joyce Boaler, 1608 Hillcrest, spoke in favor of this <br />resolution. Council Member Slavinskas made a motion to adopt this resolution, <br />seconded by Council Member Coleman. The resolution passed by a roll call vote of <br />eight ayes. <br />RESOLUTION NO. 1950 -92 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, FINDING IT NECESSARY TO LEASE REAL PROPERTY <br />FOR THE SOUTH BEND WATER WORKS. <br />
