219 <br />RESOLUTIONS <br />RESOLUTION NO. 1880 -91 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS <br />MATERIAL INCIDENT RESPONSE SERVICES BETWEEN THE CITY OF <br />SOUTH BEND AND THE INDIANA DEPARTMENT OF TRANSPORTATION <br />WHEREAS, the Common Council of the City of South Bend recognizes the existence <br />of the South Bend Fire Department Hazardous Materials Incident Response Team <br />consisting of trained personnel and equipment for response to hazardous materials <br />incidents; and <br />WHEREAS, because of continued increase in vehicular traffic transporting <br />hazardous materials on the Toll Road, the Indiana Department of Transportation <br />wishes to continue to receive the services of the South Bend Fire Department <br />Hazardous Materials Incident Response Team for response, assessment and control of <br />hazardous materials incidents occurring within its jurisdiction; and <br />WHEREAS, I.C. 36 -1 -7 -1 et seq. permits governmental entities to exercise powers <br />jointly by entering into a written agreement; and <br />WHEREAS, on June 26, 1991, the Board of Public Safety reviewed this request of <br />the Indiana Department of Transportation, and recommends that the Common Council <br />approve the renewal of an Agreement for Hazardous Materials Incident Response <br />Services with the Indiana Department of Transportation, Tool Road Division. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. That the Common Council of the City of South Bend renew the Agreement <br />with the Indiana Department of Transportation for Hazardous Materials Incident <br />Response Services and the Mayor be authorized to execute the appropriate Agreement <br />.necessary -to carry out the request of the Indiana Department of Transportation and <br />intent of this resolution. <br />SECTION II. This Resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />/s /Donald Niezgodski <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Luther Taylor, Fire <br />Chief, made the presentation for the bill. He indicated this arrangement has <br />continued to work out well for the Toll Road as well as the City. He indicated the <br />revenue was used to upgrade and replace damaged equipment. Council Member <br />Zakrzewski made a motion to adopt this resolution, seconded by Council Member Duda. <br />The resolution was adopted by a roll call vote of nine ayes. <br />RESOLUTION NO. 1881 -91 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />APPROVING THE TRANSFER OF THE $114,822.50 1990 BALANCE IN <br />THE CITY OF SOUTH BEND EMPLOYEE FLEXIBLE BENEFITS ACCOUNTS <br />TO THE SELF FUNDED EMPLOYEE BENEFITS FUND FOR THE PURPOSE OF <br />DEFRAYING INCREASED HEALTH INSURANCE PREMIUM COSTS. <br />In January of 1990, the City credited all eligible employees with a $00.00 <br />flexible spending account to be used to reimburse eligible medical expenses. The <br />total sum of $458,884.94 was deposited into a separate checking account, against <br />which account Lincoln National Administrative Services Corporation, an agent for the <br />Lincoln National Life Insurance Company, issued reimbursement checks. <br />_ As of April 17, 1991, a balance of $114,822.50 in unclaimed funds remained on <br />deposit. The deadline for submitting reimbursement claims for calendar year 1990 <br />has passed. The Common Council, with the support and encouragement of the City <br />Controller determines it to be in the best interest of the City, that the unclaimed <br />balance of $114,822.50 in the City of South Bend Employee Flexible Benefits Plan <br />account be transferred to the Self Funded Employee Benefits Fund for purposes of <br />defraying increased health insurance premium costs associated with the provision of <br />insurance benefits to City employees. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, as follows: <br />SECTION I. That the transfer, by wire transfer or otherwise, of $114,822.50, <br />from City of South Bend Employee Flexible Benefit Plan account, to Fund 711, the <br />Self- Funded Employee Benefits Fund of the City of South Bend, said sum being the <br />total of unclaimed 1990 flexible benefits funds, shall be and hereby is approved. <br />SECTION II.
