r82 REGULAR MEETING APRIL 8, 1991 This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Soderberg reported that the Public Safety Committee had met on this bill and recommended it to the Council favorable. Council Member Puzzello made the presentation for the bill. She indicated this bill would incorporate safety regulations for all individuals who are owners, tenants, or occupants of a building where a residential swimming pool is located; it would require safety ladders, requirements when such ladders should be locked and barriers. She indicated this bill would effect all pools containing 48" or more of water at any point. She indicated the barrier must be 48" or more around the pool on all sides, and above ground pools shall constitute compliance with the barrier. Council Member Niezgodski made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 23 -91 A BILL OF THE CITY OF SOUTH BEND, INDIANA AMENDING CHAPTER 20 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED "VEHICLES AND TRAFFIC." This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Soderberg reported that the Public Safety Committee had met on this bill and recommended it to the Council favorable. Terry Coleman, Administration and Finance, made the presentation for the bill. He indicated this bill allows for a contract with private enforcement service to issue parking violations. Mike Seitz, Chamber of Commerce, Carter Wolff, Director of Center City Associates, and Ron Goodwin, Insty- Print, spoke in favor of this bill. Council Member Soderberg made a motion to recommend this bill to the Council favorable, seconded By Council Member Coleman. The motion carried. Council Member Luecke made a motion to combine public hearing on the next two bills, seconded by Council Member Coleman. The motion carried. Council Member Luecke made a motion to amend Bill No. 25 -91 on page 4, by replacing the word "resolution" with "ordinance ", seconded by Council Member Coleman. The motion carried. BILL NO. 24 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO VARIOUS ACCOUNTS WITHIN THE PARKING GARAGE FUND 601 OF SOUTH BEND, INDIANA FOR THE YEAR 1991. BILL NO. 25 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING PARKING RATES FOR PARKING GARAGES AND PARKING LOTS OPERATED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA. Council Member Puzzello reported that the Personnel and Finance committee had met on these bills and recommended them to the Council favorable. Terry Coleman, Administration and Finance, made the presentation for the bill. He indicated Bill No. 24 -91 transferred funds among various accounts in order to contract for private enforcement of the City's parking ordinances. He indicated Bill No. 25 -91 approves rates charged at parking garages and lots operated by the City; and amends the charge made for after hours parking, which previously has been referred to a the "special event" rate. Council Member Niezgodski made a motion to recommend Bill No. 24 -91 to the Council favorable, seconded by Council Member Ladewski. The motion carried. Council Member Niezgodski made a motion to recommend Bill No. 25 -91 to the Council favorable, as amended, seconded by Council Member Ladewski. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Soderberg made a motion to rise and report to the Council, seconded by Council Member Coleman. The motion carried. BILLS, THIRD READING ORDNANCE NO. 8176 -91 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1112, 1118, 1122 SOUTH IRONWOOD DRIVE IN THE CITY OF SOUTH BEND, INDIANA. This bill had third reading. Council Member Puzzello made a motion to pass this bill, seconded by Council Member Coleman. The bill passed by a roll call vote of nine ayes.
