159 <br />REGULAR MEETING <br />FEBRUARY 11, 1991 <br />made a motion to adopt the resolution, seconded by Council Member Ladewski. The <br />resolution was adopted by a roll call vote of nine ayes. <br />REPORTS OF CITY OFFICES <br />Johnnie Martinez, Director of Potawatomi Zoo, gave status report on the zoo <br />visitation, as ell as the animals. He brought to aye -ayes, from Madagascar, to show <br />to the Council. <br />Council Member Zakrzewski made a motion to resolve into the Committee of the Whole, <br />seconded by Council Member Ladewski. The motion carried <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Committee of the Whole on February 11, 1991 at 7:35 p.m., with nine members <br />present. Chairman Duda presiding. <br />BILL NO. 102 -90 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE <br />NORTH EAST CORNER OF LINDEN AVENUE AND CLEMENS STREET EXTENDING <br />NORTH ON CLEMENS 988.71 FEET AND EAST OF LINDEN 480 FEET, IN THE <br />CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas <br />indicated the Zoning and Vacation Committee had met on this bill and recommended it <br />to the Council favorable. John Byorni, Area Plan, gave the staff report, which was <br />favorable. George Herendeen, attorney for the petitioner, made the presentation for <br />the bill. He indicated Midwest Acceptance Corporation planned to build a 122 unit <br />multiple - family apartment complex. He indicated the project will provide one, two <br />and three bedroom townhouses at the rate of $400 to $600 a month. He indicated the <br />project will cost an estimated $10 million dollars. Ralph Johnson, 734 N. Cushing, <br />spoke in favor of this project. Council Member Niezgodski made a motion to <br />recommend this bill to the Council favorable, seconded by Council Member Ladewski. <br />The motion carried. <br />Council Member Slavinskas made a motion to suspend the rules and allow United States <br />Congressman Tim Roemer to speak on Resolution 91 -10, seconded by Council Member <br />Coleman. The motion carried on a roll call vote of nine ayes. <br />Congressman Roemer indicated he would take this resolution back to Washington. He <br />indicated Congress has been slower to act on the Persian Gulf crisis than the City <br />Council. <br />BILL NO. 7 -91 <br />A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: FIRST <br />NORTH -SOUTH ALLEY WEST OF LELAND AVE., LOCATED BETWEEN THE SOUTH <br />RIGHT -OF -WAY LINE OF ASHLAND AVENUE., FOR A DISTANCE OF <br />APPROXIMATELY 180 LINEAR FEET. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. There being no presenter for <br />the resolution, opponents were given an opportunity to be heard. Mike Anthony, 815 <br />N. Leland, indicated he could not use his garage if this entire alley was vacated. <br />Joyce Kanewski, 820 Ashland, indicated the value of her property would decline if <br />this alley was closed. Council Member Luecke made a motion to send a letter to the <br />petitioner notifying him that this was continued until February 25, seconded by <br />Council Member Coleman. The motion carried. <br />BILL NO. 8 -91 A BILL ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH <br />BEND, INDIANA CERTAIN LAND LOCATED IN CENTRE TOWNSHIP, ST. JOSEPH <br />COUNTY, INDIANA. <br />Council Member Slavinskas made a motion to continue public hearing on this bill <br />until February 25, in order that a fiscal report could be prepared, seconded by <br />Council Member Coleman. The motion carried. <br />BILL NO. 9 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 4, ARTICLE 4, SECTION 4 -60 OF THE MUNICIPAL CODE <br />OF THE CITY OF SOUTH BEND COMMONLY KNOWN AS "TRANSIENT MERCHANTS. <br />Council Member Puzzello made a motion to continue this bill indefinitely, seconded <br />by Council Member Niezgodski. The motion carried. <br />Council Member Coleman made a motion to combine public hearing on Bill No. 10 and <br />11 -91, seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 10 -91 A BILL APPROPRIATING $4,140.00 FROM THE HAZMAT FUND TO PURCHASE <br />ADDITIONAL EQUIPMENT. <br />BILL NO. 11 -91 A BILL APPROPRIATING $ 466,652.00 FROM THE EMERGENCY MEDICAL <br />SERVICES CAPITAL IMPROVEMENT FUND TO FUND LEASE /PURCHASE PAYMENTS <br />AND EQUIPMENT PURCHASES. <br />This being the time heretofore set for public hearing on the above bills, proponents <br />
