is both adequately sized to house all of the City's vehicle repair and maintenance operations, and which shall be properly ventilated and otherwise equipped. 4. That the City owns an adequately sized facility at 1045 West Sample Street, formerly known as the National Mill Supply Warehouse which facility can and should be renovated to accommodate the City's vehicle maintenance needs. 5. That on the 3rd day of December, 1990, a petition signed by fifty (50) taxpayers of the City of South Bend, Indiana, was filed with the Board of Public Works of the City of South Bend, Indiana requesting that it acquire a vehicle maintenance facility by entering into a lease /purchase agreement with Liberty National Leasing Company, of Louisville, Kentucky, for a term of ten (10) years, with the cost of land acquisition and renovation of said facility by said corporation not to exceed two million dollars ($2,000,000.00). 6. That on the 3rd day of December, 1990 the Board certificate signed by the St. Joseph County Auditor, and the signatories of the petition are taxpayers of corporate limits of the City of South Bend. of Public Works received a certifying that the verifier property located within the 7. That having heard all speakers at the presentation and hearing on this resolution on this 10th day of December, 1990, and having taken into consideration facts adduced at this hearing and in documents and presentations, as well as all personal investigation, discussions and consideration by individual Council Members, the South Bend Common Council hereby finds, pursuant to I.C. 36- 1 -10 -7 (2), that the acquisition of a vehicle maintenance facility by lease /purchase, as petitioned by the fifty (50) taxpayers of the City of South Bend, as certified by the St. Joseph County Auditor, is needed. 9. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Member of the Common Council A public hearing was held on the resolution at this time. Jenny Pitts - Manier, _ Assistant City Attorney, made the presentation on the bill. She indicated that the resolution states that it is necessary to lease /purchase the vehicle maintenance facility. She stated that this resolution is another step in the process of acquiring and renovating the property located at 1045 W. Sample St., to be used as a centralized vehicle maintenance facility. Council Member Coleman made a motion to adopt this resolution, seconded by Council Member Luecke. The resolution was adopted by a roll call vote of nine ayes. BILLS, FIRST READING BILL NO. 110 -90 A BILL APPROPRIATING $51,000.00 FROM THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE SOUTH BEND HUMAN RIGHTS COMMISSION OF THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR BEGINNING SEPTEMBER 22, 1990 AND ENDING SEPTEMBER 21, 1991.
