,to <br />REGULAR MEETING <br />as an Economic Revitalization Area; and <br />OCTOBER 22, 1990 <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the pruposes of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution <br />designating the area described herein as an Economic Revitalization Area for the <br />purposes of tax abatement. Such designation is for personal property tax abatement <br />only and is limited to two (2) calendar years from the date of adoption of the <br />Declaratory Resolution by the Common Council. <br />SECTION II. The Common Council hereby determines that the property owner is <br />qualified for and is granted personal property tax deduction for a period of five <br />(5) years. <br />SECTION III. This resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />s /Thomas Zakrzewski <br />Member of the Common Council <br />A public hearing was held on the resolutions at this time. Council Member <br />Slavinskas made a motion to combine Resolution Nos. 1816 -90 and 1817 -90 for the <br />purpose of public hearing, seconded by Council Member Voorde. The motion carried. <br />Harold Wyland, Attorney, P. O. Box 158, Plymouth, IN made the presentation on the <br />bill. He indicated that the project will allow for the construction of a new <br />state -of- the -art ready -mix concrete plant containing approximately 10,012 sq. ft. <br />which will greatly expedite the delivery time for the purchase of concrete in and <br />around South Bend area and with will also improve the quality of the concrete by <br />the expedited delivery time since concrete is a perishable product. He stated that <br />the estimated total square footage and the estimated total cost of the project <br />which is in addition to the purchase price for the 10.35 acre tract of real estate <br />purchased for Fifty Five Thousand Dollars ( 55,000.00.) Council Member Coleman <br />made a motion to adopt Resolution No. 1816 -90, seconded by Council Member Voorde. <br />The resolution was adopted by a roll call vote of nine ayes. Council Member <br />Coleman made a motion to adopt Resolution No. 1817 -90, seconded by Council Member <br />Niezgodski. The resolution was adopted by a roll call vote of nine ayes. <br />RESOLUTION NO. 1818 -90 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br />RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF <br />SOUTH BEND, INDIANA COMMONLY KNOWN AS 419 SOUTH MAIN TO BE <br />AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A THREE <br />YEAR REAL PROPERTY TAX ABATEMENT FOR BRIARWOOD SOUTH BEND <br />PARTNERSHIP. <br />WHEREAS, the Common Council of the City of South Bend, Indiana has adopted a <br />Declaratory Resolution designating certain areas within the City as Economic <br />Revitalization Areas for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 419 South <br />Main and which is more particularly described as follows: <br />Lots 40 & 44' of Lot 41 Martins Addition to City of South Bend, Indiana <br />as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and <br />WHEREAS, the Council held a public hearing for the purpose of hearing all <br />remonstrances and objections from interested persons; and <br />WHEREAS, the Council has determined that the qualifications for an economic <br />revitalization area have been met. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I.
