Byorni <br />Executive Director Assistant Director <br />Phone 219 235-9571 Fax 219 235-9813 <br />February 28, 2001 <br />The Board of Public Works <br />13"' Floor, County -City Building <br />South Bend, Indiana 46601 <br />RE: That portion of the existing public rights -of -way known as Western <br />Avenue and Columbia Street Being a part of the recorded Plat of River Bend <br />Addition to the City of South Bend also being described as follows: On Western <br />Avenue, from a point approximately 650 feet southwesterly or Jefferson <br />Boulevard; thence northeasterly to Jefferson Boulevard; thence also on <br />Columbia Street from a point approximately 350 feet southeasterly of Western <br />Avenue; thence northwesterly to Western Avenue. <br />Dear Board Members: <br />The staff has reviewed this petition relative to IC 36-7-3-13. It is the staffs opinion that: <br />(1) The vacation would not hinder the growth or orderly development of the <br />unit or neighborhood in which it is located or to which it is contiguous. <br />(2) The vacation would not make access to the lands of the aggrieved person <br />by means of public way difficult or inconvenient. <br />(3) The vacation would not hinder the public's access to a church, school, or <br />other public building or place. <br />(4) The vacation would hinder the use of a public way by the neighborhood in which <br />it is located or to which it is contiguous. <br />The staff would recommend that these rights -of -way be vacated, subject to any utility easements that <br />may be required. <br />The staff would nit vLc,r,,,auy «�� <br />,c5 ,L, �a v,..'.,t iv',.. air r: ;I,r-:-� "-�v/,Y I,. /. The <br />vacation of these rights -of -way makes sense as a part of the development of this area. <br />It should also be noted that the closing of these rights -of -way will have an effect on travel routes of <br />both pedestrian and vehicles to and through downtown South Bend.
