15 <br />REGULAR MEETING FEBRUARY 12, 1990 <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Fire Chief Luther Taylor, <br />701 W. Sample St. South Bend, made the presentation on the bill. He indicated that <br />the bill would allow for the appropriation of funds in the EMS Capital Improvement <br />Fund. This will allow EMS to make annual lease payments on existing capital <br />leases. He stated that the equipment items include an upgraded computer systems <br />and a new heart monitor. Council Member Niezgodski made a motion to recommend this <br />bill to the Council favorable, seconded by Council Member Voorde. The motion <br />carried. <br />BILL NO. 12 -90 <br />A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA <br />APPROPRIATING ONE HUNDRED THOUSAND DOLLARS ($100,000.00) FOR <br />ENVIRONMENTAL ASSESSMENT OF FREDRICKSON PARK PROPERTY. <br />This bill had first reading. Council Member Puzzello made a motion to suspend the <br />rules and have public hearing and second reading on this bill, seconded by Council <br />Member Voorde. The motion carried on a roll call vote of eight ayes. This being <br />the time heretofore set for public hearing on this bill, proponents and opponents <br />were given an opportunity to be heard. John Leszczynski, City Engineer, made the <br />presentation on the bill. He indicated that the Mayor has indicated a state of an <br />emergency at the proposed site of Fredrickson Park. The bill requests the <br />appropriation of $100,000 from revenues of the South Bend Water Works. He stated <br />that the funds will be used for investigation of the possible contamination of the <br />proposed site of Fredrickson Park. He stated that the Board of Public Works will <br />enter into an agreement with the firm of Tenney Pavoni to perform the necessary <br />groundwater and soil analysis. He indicated that on February 7, 1990 the City <br />began identifying and testing any private wells in the vicinity of the park site. <br />He indicated that there is an amendment to the bill under Section I. the last <br />sentence shall read as follows: (This appropriation shall be administered by the <br />Department of Public Works as set forth below:) Council Member Voorde made a <br />motion to amend this bill, seconded by Council Member Coleman. The motion <br />carried. Richard Nussbaum, City Attorney, South Bend, Indiana, indicated that the <br />prior owners of the land belong to a JDK Partnership. Council Member Puzzello made <br />a motion to recommend this bill favorable, as amended, seconded by Council Member <br />Coleman. The motion carried. <br />BILLS. THIRD READING <br />ORDINANCE NO. 8064 -90 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR <br />PROPERTY LOCATED AT: PARCEL ONE BEING APPROXIMATELY <br />390 FEET + EAST OF THE INTERSECTION OF EWING AVENUE <br />AND PRAIRIE AVENUE (STATE ROAD #23) ON THE SOUTH SIDE <br />OF EWING AVENUE, IN THE CITY OF SOUTH BEND, IN. <br />This bill had third reading. Council Member Luecke made a motion to amend this <br />bill, as amended in the Committee of the Whole, seconded by Council Member <br />Coleman. The motion carried. Council Member Luecke made a motion to pass this <br />bill, seconded by Council Member Coleman. The bill passed by a roll call vote of <br />nine ayes. <br />ORDINANCE NO. 8065 -90 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA AMENDING CHAPTER 2, ARTICLE 6, <br />COMMONLY REFERRED TO A TAX ABATEMENT PROCEDURES. <br />This bill had third reading. Council Member Luecke made a motion to amend this <br />bill, as amended in the Committee of the Whole, seconded by Council Member <br />Coleman. The motion carried. Council Member Coleman made a motion to pass this <br />bill, seconded by Council Member Voorde.
