STORM SEWER EASEMENT <br />In consideration of the sum of ten ($10.00)---------- Dollars cash in hand paid, <br />receipt whereof is hereby acknowledged, the undersigned hereby grant, bargain, convey, <br />transfer, deliver unto the Civil City of South Bend, a permanent easement, for the <br />following purposes namely: The right to enter upon the hereinafter described land to <br />build, maintain, repair, as may be necessary, on, over, and across the ground embraced <br />within the STORM SEWER EASEMENT hereinafter described, and as shown on <br />attached EXHIBIT "A" STORM SEWER EASEMENT, further a permanent easement, <br />including the perpetual right thereupon the real estate hereinafter described, at any time <br />that it may see fit, for the purpose of construction, maintaining and repairing, installing <br />and renewing a storm sewer, whether used in conjunction with general street purposes, or <br />for the sole purpose of constructing, maintaining, installing, repairing, and replacing <br />and/or renewing such sewer for all purposes whatsoever, including but not by way of <br />limitation, drainage structures for storm sewer ground embraced within the storm sewer <br />easement hereinafter described, which is located within the boundaries of a tract or parcel <br />of land situated in the County of St. Joseph, State of Indiana, briefly described as follows: <br />That part of the Northwest Quarter of Section 29, Township 37 North, Range 3 East, <br />Penn Township, City of South Bend, St. Joseph County, Indiana which is described as: A <br />part of Lot # 1 of the Plat of "Ruby Plaza Minor Subdivision" as Recorded by Document <br />No. 0159618 in the Records of the St. Joseph County, Indiana Recorder's Office, and <br />more particularly described as: Beginning at the Southeast corner of said Lot # 1; thence <br />along the North line of Ireland Road, S. 89°-57'-24" W.., 283.00 feet to the Easterly line <br />of Ironwood Drive; thence along said right-of-way line for the next two (2) courses, N. <br />480-39'-45" W., 122.53 feet and N. 00°-00'-00" E., 110.12 feet to the North line of said <br />Lot # 1; thence along said North line, N. 90°-00'-00" E., 25.00 feet; thence S. 001-00'- <br />00" W., 98.82 feet; thence S. 48°-39'-45" E., 101.78 feet; thence N. 89°-57'-24" E., <br />273.58 feet to the East Iine of said Lot # 1; thence S. 00°-00'-00" W., 25.00 feet to the <br />point of beginning. <br />Subject to all legal highways, easements and restrictions of record. <br />To have and to hold the said easement unto the Civil City of South Bend, Indiana, <br />and unto its successors and assigns forever. <br />And the said Grantors hereby covenant with the Civil City of South Bend, <br />Indiana, that they are lawfully seized and possessed of the aforedescribed tract or parcel <br />of land; that they have a good and lawful right to convey said easement; that it is free <br />from all encumbrances; and that they will warrant and forever defend the title in quiet <br />possession thereto against the lawful claims, of all persons whomsoever. <br />
