Parcel Two <br />A part of Lot 34 of the original plat of the town (now City) <br />of South Bend, St. Joseph County, Indiana and more particularly <br />described as follows: <br />Beginning at the northwest comer of said Lot 34, thence East <br />and on and along the north line of said Lot 34 to a point that <br />is 21.0 feet west of the northeast comer of said Lot 34, thence <br />deflecting right 120' from the prolongation of the preceding course <br />for a distance of 44.0 feet, thence deflecting left 30° from the <br />prolongation of the proceeding course for a distance of 106.62 <br />feet parallel to the south line of said Lot 34, thence north on and along <br />the West line of said Lot 34 a distance of 28.0 feet to the point of <br />beginning. <br />Said tract contains 4472 square feet (0.103 acre). <br />Whereas, the City of South Bend has agreed to relinquish and release above described <br />easement. <br />Now this said Release of Permanent Easement witnesseth that, the City of South Bend <br />releases Permanent Easement and its rights thereunder, with the intent that the Public Right -of -Way <br />as Service Drive and Permanent Easement may be forever extinguished. <br />1N WITNESS WHEREOF, the City of South Bend, by and through the Board of Public <br />Works haAsoauthorized the undersigned to execute this Release of Permanent Easement this r <br />day of 4 '` Q-� , 1998. <br />ttest: <br />f7 <br />C <br />JAMES-1�.
