9l41r92 <br />ACCESS AGREEMENT <br />THIS AGREEMENT is entered into this <br />9rI4 day of 667—SER , <br />1997, by and between the City of South Bend, by its Board of <br />Public Works ("City"), and Law Engineering and Environmental <br />Services, Inc., 9810 Bluegrass Parkway, Louisville, Kentucky <br />40299, on behalf of Uniroyal Technology Corporation, <br />("Permittee"). - <br />4 <br />WHEREAS, Permittee requires access to the sidewalk portion <br />of the right-of-way in the following locations: the 2000-2100 <br />block of Orange Street, the 100 block of O'Brien, and the 300 <br />block North of Huey Street ("Premises") to install a total of <br />nine (9) monitoring wells for the purpose of collecting <br />underground and ground water samples to complete environmental <br />testing, and the City is willing to grant access to said Premises <br />for said purposes under the terms and conditions listed below. <br />NOW, THEREFORE, in consideration of the mutual promises <br />herein stated, it is agreed as follows: <br />1. The City shall grant Permittee access to the <br />Premises to drill and collect samples by T_ <br />means of a geoprobe and/or other means that; <br />may be required. Attached hereto as Exhib-it_ <br />A is a site plan indicating the proposed I� <br />location of the groundwater and geoprobe CD <br />investigation, and Exhibit B are diagrams of <br />a Typical Orc Well and a Typical Monitoring <br />
