South Bend Redevelopment Commission <br />Regular Meeting —April 25, 2013 <br />6. NEW BUSINESS (CONT.) <br />B. Airport Economic Development Area <br />(1) continued... <br />The Commission directed legal counsel to draft the revised document. <br />Also requested was consideration to fund a possible shortfall to bring electricity to the site <br />Unity Gardens has secured the donation of a $15,000 solar system from Innovateous Solar, <br />$20,000 from the Pokagon Band, $20,000 in supplies and labor from Herrman and Goetz, as <br />well as many other donations. Outstanding items are costs associated with the installation of <br />the solar structure and bringing electricity to the growing hoop itself. Unity Gardens <br />requests a not -to- exceed amount of $1,400 to fund these remaining items. <br />This amended Agreement incorporates the three changes mentioned above. Staff requests <br />approval of this Amendment to Temporary Use and License Agreement, and a not -to- exceed <br />amount of $1,400 to fund the electrical functionality of the site. <br />Upon a motion by Mr. Varner, seconded by Mr. Alford and unanimously carried, the <br />Commission approved the Amendment to Temporary Use and License Agreement with <br />Unity Gardens @ LaSalle Square at a not -to- exceed amount of $1,400. <br />(2) Staff report on rezoning Lots 4P, 4Q and 4R in Blackthorn Corporation Park. <br />Mr. Dressel noted that on behalf of Cressy and Everett, staff is requesting authorization to <br />file with the Area Plan Commission for a rezoning of Lots 4P, 4Q, and 4R of the Park Minor <br />Sub. The rezoning request includes a change in use from "LI" Light Industrial to "O" <br />Office. <br />Per Article 3.5 of the Blackthorn Corporate Park Declaration of Protective Covenants and <br />Restrictions, owners of more than 5% of the corporate park must seek authorization from the <br />Redevelopment Commission before proceeding with the property rezoning process. As a <br />courtesy, the Board of Directors of the Blackthorn Owners Association has been notified of <br />this action. <br />The Commission's listing agent, Cressy and Everett/Grubb & Ellis, has requested the <br />rezoning. They have an option agreement with the Commission for the property. The new <br />zoning would allow for: <br />1. Consistency with the assigned use designation of Support Office/Research for the lots <br />in question within the Corporate Park Covenants & Restrictions. <br />2. Greater development opportunities in "O" Office. <br />Staff requests Commission authorization for Cressy and Everett to begin rezoning process. <br />0 <br />
