Page 1 of 1 <br />INTER-OFFICE MEMORANDUM <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br />TO: Theresa Heffner, Clerk <br />Board of Public Works <br />FROM: Zach Hurst, PE, Sr. Project Engineer <br />SUBJECT: Open Market Contract Recissions - Projects No. 123-062J, K, L <br />619, 620, 621 Sherman Ave. TIF Project – Foundation Slabs <br />DATE: 01/29/2025 <br />On October 22, 2024, the Board of Public Works awarded three open market contracts for <br />foundation installations for new affordable duplex units on Sherman Avenue in the Near Northwest <br />Neighborhood. The contracts are funded through a Development Agreement with local developer <br />Property Bros, approved by the City’s Redevelopment Commission. <br />Mike’s Construction is a small construction company out of southwest Michigan, and a first-time <br />vendor for the City of South Bend. The City and its development partner, Jordan Richardson of <br />Property Bros, expected Mike’s Construction to complete the foundations during November of <br />2024 before the cold weather set in. Unfortunately, the contractor was not able to complete any <br />of the scope of work despite being given several months, and Mr. Richardson contracted with <br />another construction company to begin work on the duplexes. <br />Since no work was completed by Mike’s Construction and their obligations have been fulfilled by <br />another contractor, the City wishes to rescind the Open Market Contract awards and use the <br />money for material purchases to further support the duplex construction. <br />February 11, 2025
