ORDINANCE NO. 7098 -82 <br />AN ORDINANCE APPROPRIATING $500,000 FROM <br />THE 1982 COMMUNITY BLOCK GRANT FUND TO <br />SUPPLEMENT THE ECONOMIC DEVELOPMENT CAPITAL <br />FUND TO BE ADMINISTERED BY THE CITY OF <br />SOUTH BEND, INDIANA, THROUGH ITS DIVISION <br />OF COMMUNITY DEVELOPMENT FOR THE RETENTION <br />OF THE RETAIL STORE CURRENTLY KNOWN AS <br />ROBERTSON'S. <br />STATEMENT OF PURPOSE AND INTENT <br />The Division of Community Development wishes to supplement the <br />Economic Development Capital Fund to assist economic enterprises <br />through a variety of mechanisms. In particular it wishes to assist <br />the retention of the retail store located in the Central Business <br />District, which store is currently known as Robertson's,through <br />the efforts of the South Bend Development Corporation. Such funds <br />will be made available to the SBDC through the usual Community <br />Development contracting procedures and will be subject to all <br />applicable regulations and restrictions for CD Block Grant Funds. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, as follows: <br />SECTION <br />program year <br />administered <br />forth below: <br />PURPOSE <br />The sum of $500,000 is hereby appropriated <br />starting July 7, 1982 (Program Year 1982), to <br />by the Division of Community Development, as <br />PROGRAM YEAR CD 82 -1005 <br />COMMUNITY DEVELOPMENT PROGRAM <br />AMOUNT <br />Economic Development Capital Fund $500,000 <br />for the <br />be <br />set <br />SECTION II: The City, through its Board of Public Works, may <br />contract with the South Bend Development Corporation for use of <br />the funds appropriated above only in connection with a project <br />which assists in the retention of the retail store located in <br />the Central Business District known currently as Robertson's. <br />The contract shall provide that any of the above funds not obligated <br />or involved in any negotiations by the South Bend Development <br />Corporation for such purpose on April 1, 1983, shall be immediately <br />repaid to the City, pursuant to the terms of the contract. <br />SECTION III. This appropriation is subject to the following <br />condition: that each direct and indirect recipient of said funds <br />herein appropriated shall agree that fair and equitable arrangements <br />shall be made to protect the interests of any current employees <br />effected by such financial assistance. Such arrangements shall <br />include the obligation to collectively bargain with any representatives <br />of such current employees so that a policy of non - displacement <br />of current full -time employees is met. The Division of Community <br />Development shall be charged with overseeing this provision. Failure <br />to comply with the non - displacement policy, shall be grounds for <br />automatic repayment of such funds received, to the City of !South <br />Bend, Indiana. <br />SECTION IV: This ordinance shall be in full force and effect <br />from and after its passage by the Common Council and approval by <br />the Mayor.
