Z,.' � <br />U \V,�' m� s <br />COMMITMENTS CONCERNING THE USE OR DEVELOPMENT OF REAL ESTATE <br />MADE IN CONNECTION WITH A SPECIAL EXCEPTION OR A VARIANCE GRANT <br />FROM THE TERMS OF THE ZONING ORDINANCE IN AS PART OF A COMBINED <br />PUBLIC HEARING HELD BY THE AREA PLAN COMNIISSION. <br />In accordance with I.C.36 -7 -4 -921, the Owner of the real estate located in the City of South <br />Bend, St. Joseph County, Indiana, which is described below, makes the following <br />COMMITMENTS concerning the use and development of the following described parcel of real <br />estate: <br />LEGAL DESCRIPTION: <br />Lot 1030 & E % Vac Alley & S %s Vac Alley <br />LaSalle Park <br />STATEMENT OF COMMITMENTS: <br />1. Jose Luis Consuelo agrees that this Special Exception Use for automobile sales and service for <br />the property located at 3801 W Western Avenue, South Bend, IN is valid only so long as Jose <br />Luis Consuelo owns and operates the automobile sales and service facility. At such time as Jose <br />Luis Consuelo no Ionger owns and operates the automobile sales and service facility, the new <br />owner would have to re-file for a Special Exception Use in order to operate an automobile sales <br />and service facility. <br />These COMMITMENTS shall be binding on the Owner, subsequent owners of the above - <br />described real estate, and other persons acquiring an interest in the above- described real estate. <br />These COMMITMENTS may be modified or terminated by a decision of the Area Plan <br />Commission of St. Joseph County made at a public hearing after proper notice has been given. <br />COMMITMENTS contained in this instrument shall be effective upon the grant of petition <br />##_2668 -13 by the City of South.Bend Common Council. <br />These COMMITMENTS may be enforced jointly or severally by: <br />I.
