Honey Bee Keeping Regulations Ordinance <br />Page 6 <br />permit applicant or permit holder of the anneal and hearing procedures set forth in Section 4 -16 <br />of this Code. <br />Sec. 5 -54 Compliance Required; Penalties. <br />(a) It shall be unlawful for any person to keep or maintain an apiary , hive or colony in <br />the City which is not in compliance with this Article. <br />(b) Any person violating any of the provisions of this Article shall be issued a citation by <br />the Department of Code Enforcement which provides for a fine of seventy -five dollars ($75.00) <br />per violation payable through the Ordinance Violations. <br />(c) Each violation shall constitute a separate and distinct offense. <br />(d) Any person who has obtained a honey bee permit and who violates any of the provisions <br />of this Article three (3) times as evidenced by citations being issued for each violation, shall have <br />his/her permit issued under this Article revoked Said person shall not be entitled to have a new <br />permit issued for a minimum of one (1) year from said date of revocation and must provide written <br />proof that he /she has completed training on beekeeping by an entity recognized by the Indiana <br />Depart of Natural Resourced Department of Entomology Division of Entomology & Plant <br />Pathology Purdue University. Said training must have taken place after the date of the permit <br />revocation. <br />(e) Any apiary , hive or colony which threatens public health or safety; or creates a public <br />nuisance; or which has been abandoned is unlawful. The City is authorized to take all reasonable <br />action including removal and/or destruction of any apiary , hive or colony which is deemed <br />necessary. <br />Sec 5 -55 Exemptions for Zoological Parks, Schools, University, College, Etc. <br />Nothing in this Article shall be deemed or construed to prohibit or restrict the keeping of honey bees <br />in a hive stand or box located or kept within a zoological park school or university building or <br />educational not for profit entity for the puroose of study or observation. <br />Section III. Chapter 2, Article 19, Section 2 -213 of the South Bend Municipal Code shall <br />be amended by the inclusion of the following and inserted into the chart in proper numerical <br />order: <br />5 -54 Honey Bee Keeping Regulations $75.00 <br />
